Re: 124km/h in a 90 (Gardiner Expressway)

Really your best option is to go to the courthouse and choose the trial option. (Also file a Notice of Intent to Appear - you can print one off on-line and bring it, or they'll have one at the courthouse).

As far as the officer tailgating you, unfortunately that is not a defence to speeding. Although you may have done it for valid safety reasons ...

Please keep your posts regarding the same ticket to one thread. You can always add to the older thread instead of starting a new one.

These are the best I could do. Not 100% what you're looking for but something is better than nothing:

R. v. Montone, 2007

City of Sudbury v. Leikermoser, 2008

Re: Parking lot accident - Not at fault but need advice

I agree with Stanton. The Fault Determination Rules are actually quite clear on this matter and you are 0% at fault for the crash. You want to review sections 16 and 17 of the Fault Determination Rules.

Re: think my car got wrongfully impounded

Well perhaps... but who gets to decide what a suitable place is? What if the one officer decides that it's okay to be towed into someone's private garage but another officer wants to tow it to Smash 'Er Up Wrecking Yard?

Re: 3 tickets for everything except the reason i got pulled

I thought you can drive on the highway with G2 without any problem. Am I missing something in here, as I have been doing that for the past 6 months.

You are right. There is no restriction on driving on any highway in Ontario if you have a G2. It's if you have a G1 that you can't drive on a 400-Series Highway or roads like the Don Valley Parkway ...

Re: 3 tickets for everything except the reason i got pulled

Demerit points are administrative actions taken by the MTO. They only go on your record if you are convicted of, or plead guilty to, an offence that has demerit points. The courts and the police have zero control over it. If you get convicted of any offence with demerit points, MTO will automatically tack them on your record. If you don't get ...

Re: LICENSE SUSPENDED, VIOLATION OF NOVICE DRIVER CONDITIONS

Agree with Stanton - shop around. Every insurance company is different. Some that promise big $aving$ really only work if you meet very specific, narrow criteria. Others will have slightly higher rates, but will forgive you for one screw-up (collision or incident), etc. Keep looking and see what you can find. There are a lot of different companies ...

Re: shall I go to trial or make a deal if offered ?

I don't agree with what you were told. If you went to trial knowing that you had improper or incomplete disclosure, the Prosecutor would probably argue that's your problem, and that you should have taken care of it before trial.

My question: How long has it been since the date of the offence?

Re: think my car got wrongfully impounded

Yes but...

A police officer or an officer appointed for carrying out the provisions of this Act who discovers a vehicle apparently abandoned on or near a highway or a motor vehicle or trailer without proper number plates may take the vehicle into the custody of the law and may cause it to be taken to and stored in a suitable place .

Define ...

Re: Insurance

If the vehicle is not registered and you don't have insurance... you could get nailed for driving an unregistered/unplated vehicle AND for driving without insurance.

The Compulsory Automobile Insurance Act says "any owner or lessee" must have insurance for any vehicle they own/lease (section 2). I think that means that the vehicle requires it ...

Re: new car impound law

Yes I know the government will seize anything it likes. I realise that, I was just wanting some facts about how they can take property from anyone without it being called theft like if we were to do same

Simon Borys pretty much explained it. It's not theft because the government is taking it due to its use for an unlawful purpose. They can't ...
