Following too close, can a charge be laid?

This happened today and got me wondering.

My son was riding his bike in front of our house when a driver shows up out of no where following him too close, this got him very scared and barely managed to pull into our driveway and complain to me.

So I'm wondering if a driver can be charged for following a bicycle too close under HTA, section 158(1 ...

I read a case where prosecutor argued and successfully blocked introduction of some evidence by the defendant.
The reason was "foundation" of the evidence was not laid properly to introduce the evidence (according to court procedures). The second section in brackets is because I'm not sure about it, but I'm certain of the first part.

Guess if you don't like the inconsistency and the human factor of law enforcement, they should put up more red light cameras and bring back photo radar. That keeps everything consistent.
Not to worry, it won't be long before photo radar is back, my guess is 2-5 years.

This was a great question, my son keeps bugging me about riding in the front seat and I tell him NO.
But the truth is I had no idea when he would be allowed in the front "legally" although even if he was, I would not let him ride in the front anyway.

I visit a Husky gas station in Mississauga on regular basis, the price is always cheaper than other stations. The problem is, this station is a truck stop and some truck drivers want to run over any 4 wheel cars coming in or out of there.

It's the inconsistency of police response that frustrates people. My old service just released their weekly roundup. They reported two incidents where someone rear ended another car. One got a follow too close ticket and the other got a careless.

I seem to recall that section goes on to say that a municipality may pass a bylaw and to post a different speed at either of those default speed limit zones.
I will have to dig up my notes, but I'm 90% sure.
Although, arguing what is built-up and what is not built-up might be more challenging than you think.

Personally if I was in your situation I would file two motions:

1. 11B under the charter for unreasonable delay
2. section 7 under the charter, failure to provide disclosure

With these two motions it would be extremely hard to believe that crown would continue to proceed, they don't have the time to deal with this much headache and would simply ...

If I was the prosecutor and you don't show up, instead a hired gun shows up, I would figure you can afford the fine and I would offer less of a deal.

Reduction of speed is the easy one, once you see a reduced speed limit ahead you start slowing down so when your are parallel with that speed limit (50 for example) you are in fact travelling at that speed.
Acceleration would be the same for me, and I would simply ignore people honking, you can't let others push you around and force you to break ...

One more thing about video, based on what happened with my wife's trial.

Just because the officer says there is video recording of you, it does not mean that is the case or game is over.

I requested the video of my wife's alleged infraction and it dd not exist, even though she was told by the officer he had such evidence.

+1, if you bring this up before trial it will simply be corrected.
But , if you get the officer on the stand, you could use this in conjunction with other matter(s) to bring reasonable doubt and to the fact that the officer is only human and can make a mistake .
Thus, perhaps he made a mistake reading the speed on his radar the same way he made a ...
