I don't believe the HTA specifies a distance.


Looking at HTA it specifies where U-turns are not allowed and no sign need be posted, on a curve, bridge etc.

So I'm guessing if a sign is posted and one disobeys it, it falls under disobey sign

What section of HTA is that? I seem to recall there is a general section that referred to when issuing ...

Normally no U-turn signs are posted by specific intersections aren't they ?

No, not always...
For example, there is a no u turn sign in the middle of the road here

U-turn prohibited

Here is a question I have had in the back of my mind for years and never found a solid answer to.
I'm hoping the knowledged officer on here can clear it up for me...

The question is, how far before and after a No U TURN sign a driver is not permitted to make this turn?

For the permit, you have a good case...
One, the officer is not going to purger himself/herself, most likely something went wrong and ticket did not get canceled, I doubt you will need to do much on this one.
For the stop sign however, you might have some fighting to do.
Back to permit, having stickers on the back of permit to validate it is not ...

Couple of more things...

First, you should NEVER proceed to make a turn if you do not have a clear view of oncoming traffic. This accident could have been much much worst, imagine if you were hit by an 18 wheeler, you would probably not be here asking for advice, just think of that and count your lucky starts.

Just to expand on what jsherk said above, the prosecutor will choose what he/she will offer as a plea bargain, furthermore and I am not 100% sure about this, but I think they are also constrained by what they can offer as a deal depending on what the original charge was .
What I mean is, they can not replace a "failed to stop at stop sign" with ...

I find it odd that one would have to submit an FOI application for these tapes.
Last time I checked, the plates could not be read with these cameras, so I don't see why the red tape? MTO should simply process the request for the fee they charge.
Especially since they only keep the video on file for 5 weeks, sending in a FOI application can delay ...

Did you have your visor up or down? Maybe having the face shield up was sufficient for the officer to identify you to his/her satisfaction.

You said this was in front of a school, if it is something like York university, they have their own parking enforcement officers, to which they can not enforce the parking ticket unlike regular Toronto parking enforcement officers.

To be honest, I don't think that formula is very good...

You need to take into account many variables, road condition, your tires, your vehicle stopping power, your own response time, other cars around you, open space to steer away to avoid a collision and who knows what else that I can't think of.

This is not a speeding ticket. With speeding, you are speeding or you're not. This is a ticket where the offense is largely based off the opinions of an officer. So just heard on the news that a new regulation is being implemented, soon police officers stopping people will need to advise them they do not have to talk to them. Odd if you ask me, because it makes the entire process moot since right there that individual can turn around and say "OK, then I'm walking, ciao".

In a nutshell, the maximum speed limit is 50 km/h unless posted otherwise.
So you can not use the argument of no sign was posted if he charged you with speeding in a 50 zone, if he charged you with speeding in a 40 zone, that is a different discussion.

You have not mentioned what rate you were charged with in what zone, so it is a little ambiguous ...

Based on what I have seen and read from other people, early resolution is a waste of time. The reason I say this is because at the early resolution meeting you are expected to take a plea deal, which is basically pleading guilty to a lesser charge, which in turn affects your insurance no matter how you slice or dice it.

There was never any actual law or regulation providing a grace period , it was something officers would simply do (and still do). Unfortunately it's a bit more complicated now due to e-ticketing. I never check my plates to make sure the sticker did not come off or some one did not steal it, never...
The only time I ever look at it is when I get the new one and clean the old one so I can make sure the new one is on there securely.

You may also have to check where the stop sign is actually posted. If it's at an exit, it may be posted close enough to the highway to be on municipal property and therefore legal.

I have a question regarding stop signs you see at the entrance/exit of some plazas.

Years ago, when I started to drive I was told these were stop signs on private property and HTA did not apply to them, therefor police would not issue an infraction notice if one would not obey them.

Quite often that charge is laid because the driver talked himself into it, or, the driver was getting a break on something else so the cop laid that charge which is no points. If the validation sticker is missing, it would still come up as valid when the cop ran the plate during the stop. If the plates came up as being valid, but the sticker was ...
