If you ask for a stay from the JP when you are called up to plead and you get an adjournment, your new court date will most likely be one on that JP's next scheduled court dates and not the date that the officer has his/her cases scheduled for (maybe adds another 2 to 4 months). Did you get the same JP for your second trial date?
OK, so here is a question for all of you who went to trial and got an adjournment.
Was the JP the same one or did you end up with a different JP?
Second part to that question would be "is there a way to get a different JP if you feel he is not being fair?"
I'm trying to find out if there is a chance that I would get some one else, or what the odds ...

Yes, the phone number on the attached 16b affidavit sample is incorrect.
But that file is just a sample. It's the user's responsibility to check all info.

Just wanted to give every one a heads up, the number listed on the sample 16b form is wrong, that is the phone number for the Attorney General of Canada, not the fax number.
So when you go ahead and use it, you should correct it before filing it or it could throw a monkey wrench in your proceedings if the prosecutor picks up on it.

I am going there in person on Wednesday to file my motion, I think I'll go there with all 3 dates on hand and find out which one it is, then file the correct one.
I hope the court clerk can look it up and tell me, keeping my fingers crossed.

I believe you have to serve the Court and Prosecutors where the trial will be held.
If you read our quick guide above, please note that the sequence for the Toronto Downtown court is a bit different, because it involves extra steps.
