Re: Unique Defense

It's a bunch of bunk...

Canada and it's successive governments, like all nations have adopted laws to protect their people and assert people's rights in a balance with the rights of society.

Yes it's an imperfect system...but the alternatives are no less perfect.

Could we return to a feudal system? Great...then how do we prevent drunks and 9 ...

Strange I had an 05 Mustang (the nice new retro style) when they first came out...drive all over TO and cottage country, prior to that an 03 BMW M3, my wife had an Auti TT Covertible...I think we can agree those are flashy cars...add my Italian Sportsbike to the equation for that matter...

No officers in the GTA / OPP would know my cars...

You must get stopped a lot. Why?

I bet the average driver gets stopped once every 10-15 years...I'm thinking rather than get a video camera, you need to go out and get yourself a clue if you are getting stopped that often.

I got tazed in training.

Ouch!!!

But it last 5 seconds not 45 minutes like OC spray.

I much prefer the tazer, hurts like every muscle in your body severly cramping at once, but it's over in 5 seconds...

Of course I'm not overweight, have a pre-existing medical condition, not high on cocaine and am not engaging the police with intent to escape ...

The society of which I speak is called Canada.

All Canadians deserve the RIGHT to travel in safety. You should not be harmed going about your daily business because other chose to flaunt the laws leading to your injury or death.

I think all traffic fines should go to charity, that way once and for all people would stop thinking that traffic ...

I would say it depends when you changed your address.

If you changed months ago then I suggest you are fubar-ed. If you changed it and after a reasonable time (2-3 weeks) you hadn't received an updated one, the onus is on you to follow thru and get the updated copy, via MTO.

If it was recent, then you might have an arguement.

Well you hit a vehicle that was ahead of you that stopped?

If the evidence doesn't clearly describe follow to close not sure what would?

Careless Driving also fits, so I suspect the officer cut you a break.

You did cause the accident, and the duty of the vehicle in front of you doesn't include braking in a user friendly manner so they'll bare no ...

Nothing magical there PaulinCanada.

Courts have recognized that when you do this daily over the course of years you get good at estimating and really anybody can develop the skill...

After 2-3 months on the job I was almost always bang on...I'd estimate 100 km/h and activate the radar 103km/h.

As the driver of a motor vehicle you are responsible to make sure you have the required documents to operate the vehicle and that you sticker is up to date etc...so there isn't much of an arguement there.

As for the time, I would speak to the prosecutor...they do have the ability to amend the ticket per R. v. Winslow which is the authority on ...

Re: Driver definition

That's one definition...

The Highway Traffic Act of Ontario defines driver as - "driver" means a person who drives a vehicle on a highway.

So that's the definition.

Each statute may set out it's own definitions, so don't get too hung up over what another book may say, when it comes to the HTA, it's the HTA's definition that matters.

Here's a few questions:

How can you tell which people warnings work with and which it won't?

Why do police have to warn people when they have a duty to know the law?

Statically warnings don't fix the problem. Sure most people will take the cover off, but cause we can't stop everyone, a large number will not. I've personally had several drivers ...

Well I suppose it could be argued you should have got a warning, but then everyone else should get one too right...where do you draw the line on warnings?

I suppose we could all go around everyday and warn everyone all the time, but then really people would not fear the consequences and just say I'll just do it til I get a warning, then wait to ...

By the way, I really hope you are more of an aberration than a typical constable considering your lack of respect for the proper legal process. While our Charter is largely useless as long as NWC's invoked, it should still give us some guarantees regarding fair treatment by law enforcement officers and the courts. Those guarantees were created to ...

Weird, I've charged maybe 75 times under that section and always gotten a conviction...people bring their 407 bills, but the 407 is known to make lots of mistakes...and clearly if you've changed the apparent colour of the plate it's confusing the identity. Plus a tint of any kind makes it harder to read as it lowers contrast. I had one JP state ...

This is unfortunate. But I'll cast my perspective on this...

255 in a 100 km/h zone? Yikes that's just plain dangerous driving (Criminal Code)...I can't see any reasonable excuse to go 155 in a 100...even the police who get special training are instructed that at about 40km/h over the speed of traffic your training won't help you...
