Parking lots are private property and it's very unlikely that an owner would grant permission for someone under 16 to drive a motor vehicle on the lot. Too much of a liability issue.

If driving was a "right" then there would be no ability to enforce even simple traffic violations, suspend licences or regulation any use of the highways.

We were taught that in a rural are its fence line to fence line and it a city it's "store front" to "store front". Most cities own a portion of the property up a residential front lawn for the purposes of installing infrastructure etc.

The problem with this is that the "court" will not see your disclosure request. Only the prosecutor will and they will likely only give you the testing procedure. In order to get the entire manual, you may have to justify the request in front of the JP and of course, the prosecutor will also have a chance to say why they don't have to give it to ...

Your opinion is he was off by 26 km/h. He would probably say different. That's why we have a court process.

That's an easy skill to learn if you are using radar or lidar regularly and be within +/- 5 km/h ever time.

It's just one signal (beam). The easiest way to explain it is: The strongest signal returned is used as the patrol speed of the police vehicle and the second strongest signal is the target.
Inside the radar, the single signal actually gets split to do the calculation of a patrol speed and target speed.

In newer Genesis units, the fast selection isn't even required. The radar automatically detects whether the target is faster or slower.

It's not a feature of any Decatur product that I know of. However, If the radar is paired with a video camera in a police vehicle it would be possible to overlay gps from either the radio or dispatch system.

The Ontario Drivers handbook is available free online and has some good illustrations of where to stop. The front of the car is to be behind to stop line.

1- That's a Saskatewan case and isn't binding in Ontario at all.
2- It appears that whatever radar they were using, still required the use of tuning forks for testing. (Some brands still do)

They don't try to amend it before the trial. They simply give the accused notification before they plea that they will be amending it up if they enter a not guilty plea. This also lets the JP know that the accused was fully informed about the possibility of an amendment.

It's not a traditional type of fatal error though. In a normal fatal error a JP can look at their copy of the ticket and quash it. Eg. Fine missing, date missing.

Just so you're aware, in most cases, the entire manual is not required to be produced in disclosure. Only the testing procedure. Just because you ask for something doesn't mean you get it.
