Generally it is rare for incarceration for first offence .... Not saying it's not possible, but very very rare.

Usually is a 1000$ fine and additional 6 month suspension

It would work, just that you would start at the bottom with a G1 class license and have to work your way up through the graduates license system. You would be bound by all the driving conditions of a g1 licence, ( be accompanied by qualified driver, no driving on 400' series hwy, and so on)...:

Well, I guess this just proves the complete and utter scam the driver licensing system has become. They gave legal monopolies to drivetest centres + licensing centers and essentially milk the public for every dime possible. Its unfortunate that government programs are being judged on their intent versus their actual results. I am glad I am leaving ...

If he charged you under a municipal by law, then it's good. But the highway traffic act doesn't cover private property. Only a few offences under the HTA can be laid anywhere, but a stop sign isn't one.

I have seen them accept the record when not under sign / seal of MTO. I've seen the crown ask the defendant if that is their record, says yes, and gets passed up ....

If there is no witness the case can't go ahead. Period. So either a adjournment which if it was me I would object to or dismissal of charge.

Other factors would come into the careless charge, road / weather conditions, light cycles, speeds, injuries, damages...

I would not take anyone's 100% guarantee as there is no such thing.

It's not double dipping. I know people that have gotten convictions on them. Personally I wouldn't lay both unless the person talks themselves into it. I also agree that there is a good chance that it would be withdrawn, but there is no guarantee with that.

The fact you don't hold a QC licence doesn't make any difference. You right to drive in Qu©bec had been suspended.

I would try to contact the SAAQ to see what steps you can take.

It is a criminal prohibition that is handed down by the courts. Ontario Gov't has noting to do with it other than following the courts direction.

Life suspension means life suspension. You lost your right to drive and I for one am glad.

Life time prohibition is that. Penalties are there for a reason and ment to be a specific (you) and general ( public ) deterrent.

Frankly I would say you have no leg to stand on, but who knows. Completing a back on track course might help others but I doubt it would help you as your prohibition is for life.

Not at all. He could have gotten several readings.

The flip side could be that the 8 could be mistaken for a 0 and the other way around.

It is not a fatal error.

I'm 99.9999999% sure this was just a verbal warning and that's the end of that.

I have used that line several times but did follow up with telling them they're not getting a ticket.

I have used that arrest authority several times and impounded the vehicle until the peron dealt with their matters in court. I have even brought people in for bail court for driving under suspension.

S.217 lists the arrestable offenses under the highway traffic act, and driving under suspension is one of them. It doesn't matter if its the first ...

Not unless they were suspended by court order or by criminal code convictions. If you did, they could successfully appeal and you might have some explanation to do since your office would have to reimburse ...
