I believe they send you at least one notice with the fine if not two. On that it clearly states if you do not pay your licence will be suspended. Not getting it because you had moved and failed to update your address is not an excuse as you are required to notify the MTO of any change of address.

Making you move to a safer spot is quite easily to articulate. So if he made you call a cab and you have to pay for that, would you think one would complain about him / her not having a heart ...

On the back of your ticket, it states that you have 15 days to decide what you want to do. If you do not respond within 15 days, you are deemed not to dispute.

Its called the stop watch method. You calculate the time it takes to travel a known distance, and then that figure is punched into a calculation.
The speed obtained is the average speed over that time.
The formla is
S (speed). = D (distance)

Yes to both. The officer on the ground is charging the person based on the person in the planes information. Both would be required to attend court.

It is only post poning the inevitable. They have upto 6 months to serve you unless its a no insurance charge then it is 3 years.
Call and arrange a meet get this done with. If you go into hiding to avoid service I doubt the crown would be willing to make too many deals with you.

Police typically can't lay Highway Traffic Act charges for accidents that happened on private property. Regardless, insurance fault rules still apply. Typically the driver who struck the other vehicle from behind is 100% at fault.

well that way you are also being transparent and fair as is expected from the crown.

For sure print the entire thing. Make 3 copis on for you to refer to one for crown and one for JP. I would high light and put tabs on where the parts you want them to look at.

Stanton, 9 out of 10 times, it doesn't get raised back up to the original fine. If it goes to trial and a conviction is entered they will add the court costs which puts it higher than the set fine / total payable for the offence if it wouldn't go to trial. But really what do you have to lose, not a whole lot.

I have heard of this mentioned in court on an unrelated trail. The 14 day grace period if you have an existing policy with the company it covers vehicles you purchase.

I have personally sat through court in Ottawa when someone tried to argue this exact point. Mind you that the guy just read something he printed off the Internet. I can't remember which section the prosecutor pulled out or quoted but he quickly shut this down. The JP that was sitting was also aware of this tactic and wouldn't buy it .

Yes you can represent her but unless you were presen when this occurred you will not be able to provide testimony.
The fact that the licence plate is wrong is not a fatal flaw that would warrant the charge to be thrown out.

If you request disclosure and you get the calibration dates which you most likely will, it would be hard to argue that point.

I am not sure this is completely correct, as it does come up on the driver's abstract. Further to that it is regarded as an Alcohol related suspension, so its quite possible that it will.
