Re: speeding 15 and under
What to do!.....1 week to go. You have to make a decision within 15 days of receiving the ticket. That's not a lot of time to consider your options. Even if you have absolutely no intention of fighting the ticket, by requesting a trial, you delay judgment day for several months. You can plead guilty and pay the fine at any point over the next ...

Re: 79 in 50 zone
Can he ticket me if he is illegally parked? It's not about him, it's about you. The issue will be whether you were speeding.
Am I actually speeding if I am decelerating? If you are going faster than the posted limit, you are speeding.
Do I lose points for 29 km over? There is a demerit point link at the bottom of this page. And yes you do gain ...

Re: Proceed contrary to sign at intersection, 144(9)
I know this thread is old but I was browsing through and couldn't help putting my two cents in.
Regarding the time of day being close to when you are/not allowed to turn, you can mount a strict liability defence stating you believed the time still permitted you to make the turn. You are morally innocent, especially if we are talking about only a ...

Re: speeding 15 and under
Less than 15 over is as low as you can go for a speeding ticket and you don't get any demerit points (contrary to popular belief, you don't loose demerit points, you gain them). It's very tempting to accept this.

Re: Disabled person parking ticket - $350!! Help!!
Both my parents had disabled permits. When I would drive them to the mall, all the disabled spots would be taken. I would drive up to the entrance, let them out and then park. When it was time to leave, I would go get the car and then pick them up while they waited by the entrance. If I took too long, they would start to get worried and panic. They ...

Re: Jeep Wrangler with Windshield Down?
Watch those "p's and q's".....some of us are trained identical to MTO officers. Let me clarify. It wasn't meant as a slight against police officers. Here is an individual who wants to drive a jeep on-road and is taking more than reasonable care to determine if it is legal to do so. Contact with the police department has been less than helpful. In ...

Re: Disabled person parking ticket - $350!! Help!!
It's covered under the HTA:
And the details including sign requirements are covered under Regulation 581.Offence, disabled person parking permit
27. (1) No person shall,
(d) use a disabled person parking permit on land owned and occupied by the Crown otherwise than in accordance with the regulations;

Re: Jeep Wrangler with Windshield Down?
If you were on a motorcycle and got hit by a rock it would be the same thing, although it would cause less damage.
When you have a vehicle certified, the mechanic inspects it to see if it's road worthy. You may want to go that route (and take pictures at the garage in case you get a ticket). The mechanic is certifying that you are OK to drive on ...

Re: If I dont get disclosure
I had an experience last week that could maybe shed some light on this problem. After 6 straight hours behind the wheel through the middle of the night, I suddenly got very tired just 1/2 hour from home. I thought I could manage the rest of the trip, but found myself wandering a little in my lane. I chose to stop and power-nap for 5 minutes or so ...

Re: Jeep Wrangler with Windshield Down?
Sections 66(1) and 67 deal with mirrors. You could mount the rear view mirror to the frame and the side mirrors to the body just front of the door hinge

Re: U-turn
Some insurance companies count demerit points and others just count convictions. For example three convictions with no demerit points could raise your rates while two convictions of 3 demerit points each won't. It really depends on the insurance company and their policy.

Re: If I dont get disclosure
In Toronto, disclosure can take eight weeks. I don't know what the Barrie office is like, but July 17 to early September is not a lot of time FOR THEM to prepare disclosure.
The amount of time to schedule the trial (June 25 to September) is very short, only three months. They can take up to eight months which means they have more than enough time ...

Re: Red Light- Fail to stop Pedestrian controled Light
This one is really interesting. The lights should be timed to allow for the width of the intersection and the speed of traffic. A yellow light should last longer if you have to cross eight lanes of traffic than if you only cross two. And depending on the speed (40kmh or 80 kmh) you'll need more or less warning time to slow down and stop. The ...

Re: Television/DVD Player Visible to Driver
I think you can create reasonable doubt by asking what the officer actually saw on the screen. I doubt he will remember. He probably saw a screen larger than a GPS and asssumed it was a DVD unit. He wasn't aware of what your unit has (and it sounds like an awesome unit). Bring the manual to court as proof. If your unit had any of the other driving ...

Re: "It's just a dog, you can get another one"
This reminds me of all those stories you hear about people swerving into oncoming traffic to avoid running over a squirrel. I love animals and we should do more to protect them, but in Ontario you can't speed to drive your mother to the hospital let alone your dog.
