can you elaborate on what you mean by the last comment about attacking the foundation of the charge? When you walk into court you have a presumption of innocence which should mean there is reasonable doubt about the evidence presented against you. In order to ...

Re: Ticket going 45 over - instead of 15
I just drove by that spot today. At 60km/h it takes about 2.5 seconds to reach Logan from the sign (about 42 metres). At 105 km/h it would be about 1.4 seconds which is the amount of time he has to aim and take a reading. Acquisition time is usually around 0.38 seconds for lidar plus he's also got to pull the trigger. Way too tight. Plus the angles ...

Well I invited myself to this forum and I'm extremely appreciative of the opportunity to learn and debate these topics with some very knowledgeable people. We discuss the arguments, not the typist. And we are all the better for it. I should know, Bear baked me a humble pie.

P_Joe, I would pursue the fatal flaw on the ticket argument. Bear, agreed that there is a lot of case law that is BS. The biggest one is R. v. Daviault . In Toronto, the cops and prosecutors have known about the bilingual requirement for four years but they still continue to lay charges. And unless you know about Myers, you will be found guilty despite being completely innocent.

The cop can stand wherever he wants. If he's on private property, the owner can ask him to leave. It does not affect your ticket.
The court will only consider whether you committed the offence. The trial is about you, not the cop.

Re: Speeding in Community Safety Zone
Your notice of trial will have the charge listed as speeding (and only speeding!) The court has to determine whether you were speeding. They then calculate your fine. If you were speeding in a community safety zone, then the fine is double.
If the cs zone doesn't exist (because the sign wasn't bilingual) then your speeding fine is just the regular ...

no police force in Ontario uses X-band any more. So what's the flippin' problem? Nobody manufactures x-band anymore but I've seen estimates from 0 to 20% that they are still used somewhere in North America in smaller forces that don't have the budgets to replace everything.

We are dealing with what YOU were charged with, not what some CBC reporter wrote. You were NOT charged with stunt driving, you were NOT charged with the CBC's "driver crowding", and you were NOT charged with careless driving which has 6 points.
Focus on your s. 78(2) charge which does not carry any demerit points.

A similar topic was discussed here . It sounds like you were charged with careless driving not stunt driving . I just looked at the reg and I don't see any mention of a television but section 78 of the HTA does cover it. And I think the fine is too low for stunt driving.

CB, you are likely concerned about the impact of this charge on your insurance and your employment. Both can be affected. You won't have a clean driver's abstract if you apply for work elsewhere. Insurance companies can count either convictions or demerit points or both.

1. Shouldn't 45 over automatically require a court date set? Automatic court dates are only required for summons (to appear in court). Your offence was not severe enough.

Can this charge get worse if I go to seek clemency? The good news (if you can look at it that way) is that it can't get any worse. You are already charged the full amount. And you will get 3 demerit points.

I agree with Reflections (except for the math part). 755 people were penalized for something they were never convicted of. And of those, 229 were not guilty of anything. That's just wrong.

Don't we already have a similar limiter installed on most cars? Limiting the speed to no more than ~170 If you redline the tach there are rev limiters that cut in to stop you from burning out the motor. I know there are some utility vans (I think GM or Ford) that have speed limiters. The motors are powerful for hauling stuff but without cargo ...

Re: going 50 over the limit
Radar can round up the figure. For example, a speed of 140.3947 km/h would read 141 km/h. To offset the rounding error, there should be a reduction of 1 or 2 km/h. I can't remember where that's posted. FYST?Bookm wrote:Do the laser/radar manuals not specify an accuracy tolerance of 2+/- kph?? I'm sure I read that on another forum somewhere.
