I don't know if this is true or not but a prosecutor told me that lane markings are not enforceable (solid, dashed, yellow or white) they are only recommendations. S.182 is about disobeying signs, not lane markings. I can't find any HTA entry against disobeying lane markings other than going left of centre of the road!

I know that stretch as well ...

I don't think you can win either way. If you terminate and reapply, one of the questions they ask is any convictions in the last five years?

Try calling around to some insurance brokers and see what they recommend. Make sure they've dealt with this situation before.

You have an excellent chance of fighting this ticket. The signs in Mississauga have to be bilingual otherwise they are not enforceable. I am more than willing to admit when I am wrong. Like my friends who received tickets while on bikes and got demerit points, I too was not aware of the "bicycle" designation rule on the vehicle type box . You should always state you want to challenge the evidence of the officer. He may not show up in court since you don't want to question him. In other words, you are agreeing with his evidence. It's harder to dismiss the charge or get a stay if you are agreeing with the evidence that shows you are guilty.

It sounds like the December date is a First Attendance meeting where the prosecutor will try and convince you to plead guilty to a lesser charge. You should request disclosure first. It makes no sense to plead guilty to anything until you have seen the evidence against you which will also include witness statements.

A couple of things. There are demerit points for cyclists if they have a driver's license. The City of Toronto info you quote is confusing and the writer is making an inaccurate conclusion based on a deferral to a regulation.

Second, are you now saying the other driver wasn't charged?

Don't panic, you've got lot's of time. First, request a trial. Requesting the trial will buy you time to think and research. It will take months before your trial is scheduled. You can always pay later if you change your mind.

I wonder if the speed over the ground is a factor; i.e., the little computer likes a relatively high rate of angular change between it and the satellites, and at a walking pace the rate of change is too slow. You nailed the GPS accuracy bang-on. A lot of people mistakenly assume consumer GPS equipment has "pin-point" accuracy but the best it can do is about 15m. The GPS signal is managed by the US Air Force (50th Space Wing) which encrypts it. The pin-point accuracy is reserved for the military.

You don't have enough to squash the ticket. Typically in Toronto the trial is where the officer works, not where you were caught. From Scarborough to Etobicoke, it's all Toronto!

You can negotiate with the prosecutor to reduce the charge so you avoid demerit points (ie speeding 15km/h or less) but you still get the insurance hit. The JP doesn't ...

I think you skipped a step: you got a ticket and then a suspension. What was the charge and what happened in court?

If your demerit points after the conviction totaled 9 then you get an automatic 30 day suspension.
