I don't know if this is true or not but a prosecutor told me that lane markings are not enforceable (solid, dashed, yellow or white) they are only recommendations. S.182 is about disobeying signs, not lane markings. I can't find any HTA entry against disobeying lane markings other than going left of centre of the road!

I don't think you can win either way. If you terminate and reapply, one of the questions they ask is any convictions in the last five years?

Try calling around to some insurance brokers and see what they recommend. Make sure they've dealt with this situation before.

You have an excellent chance of fighting this ticket. The signs in Mississauga have to be bilingual otherwise they are not enforceable. You should always state you want to challenge the evidence of the officer. He may not show up in court since you don't want to question him. In other words, you are agreeing with his evidence. It's harder to dismiss the charge or get a stay if you are agreeing with the evidence that shows you are guilty.

It sounds like the December date is a First Attendance meeting where the prosecutor will try and convince you to plead guilty to a lesser charge. You should request disclosure first. It makes no sense to plead guilty to anything until you have seen the evidence against you which will also include witness statements.

A couple of things. There are demerit points for cyclists if they have a driver's license. The City of Toronto info you quote is confusing and the writer is making an inaccurate conclusion based on a deferral to a regulation.

Second, are you now saying the other driver wasn't charged?

Don't panic, you've got lot's of time. First, request a trial. Requesting the trial will buy you time to think and research. It will take months before your trial is scheduled. You can always pay later if you change your mind.

You nailed the GPS accuracy bang-on. A lot of people mistakenly assume consumer GPS equipment has "pin-point" accuracy but the best it can do is about 15m. The GPS signal is managed by the US Air Force (50th Space Wing) which encrypts it. The pin-point accuracy is reserved for the military.

You don't have enough to squash the ticket. Typically in Toronto the trial is where the officer works, not where you were caught. From Scarborough to Etobicoke, it's all Toronto!

You can negotiate with the prosecutor to reduce the charge so you avoid demerit points (ie speeding 15km/h or less) but you still get the insurance hit. The JP doesn't ...

I think you skipped a step: you got a ticket and then a suspension. What was the charge and what happened in court?

If your demerit points after the conviction totaled 9 then you get an automatic 30 day suspension.

Well technically black is the absence of color or specifically, the absence of light. That is, black does not reflect or emit any light to the visual receptors in the eye. That's why you can't see black ice. But since we are so off topic: Bear, I concede, you win! :)

BTW...no such thing as "black ice" From wikipedia: Black ice is ice frozen without many air bubbles trapped inside, making it transparent. Black ice takes the color of the material it lies on top of, often wet asphalt or a darkened pond. Bear you're right. I was pointing to an example where 60m is mentioned. At the bottom of the reg under a section titled "General" is the uber clause:
45. A sign prescribed by this Regulation shall be so placed as to be visible at all times for a distance of at least 60 metres to the traffic approaching the sign. R.R.O. 1990, Reg. 615, s. 45.

Careless driving is one of the most severe charges under the HTA (6 pts and/or the possibility of imprisonment). It is also the most overlaid charge for what amounts to minor accidents. ( Here is an example of a guy,going 2mph trying to squeeze past a garbage truck and ended up cracking the side mirror and was charged with careless driving!)

In R. v. Aristidou, 2007 ONCJ 250 the charge was amended by the police officer before handing over the ticket. After that, the court has to amend the charge. I know I'm jumping the gun but I don't think this is an HTA offence. I think it's under POSSESSION OF LIQUOR IN PROVINCIAL PARKS, R.R.O. 1990, Reg. 723 which is a part of the Liquor Licence Act.

Also this sounds like coercion on the part of the parks officers.

I know this is a little late but when you get the notice of the license suspension in the mail, you can request a reopening of the trial based on the fact that you did not get notice of trial or conviction.
