First turn over each ticket and read the instructions on the back to request a trial. Then do it! You only have 15 days. This will buy you time to do your research and prepare.

Second, please site exactly what you were charged with (which sections i.e. HTA 130).

It sounds like it was dark, there was a loud screeching noise at the officer got spooked. He then went on a fishing expedition to charge you with something. It doesn't sound like 27(1) a. is an appropriate charge as the permit was probably left in the car as opposed to fraudulently obtained.

The charge sounds right for what happened IF it's true. You should be more concerned with the insurance increase.

A couple of points (OK several):

1. Was there a stop sign? Go back and check. If there wasn't, then the charge is wrong.

I remember the air surveillance but I thought it was the cost that did it in. The signs seemed to stay much longer than the program. You may wish to go to the library and look at microfiche of older newspapers (there's an index) to see when the program closing was announced.

Hang on. They're charging you $5??? Disclosure is free and the Crown is obligated to provide it to you, not charge you. It sounds like they are confusing your request with an FOI request. An FOI request does cost $5 which is the deposit for the initial inquiry. You pay the actual photocopying costs later.

Theoretically it is not illegal to cross a solid line on its own. But the line becomes solid for safety reasons or it is near an area (crosswalks, intersections, hills, railway crossings) where it is illegal to "pass".

The officer would have no way of knowing where you live unless you told him something to warrant the charge:

Example 1:
Officer: Do you live here?
You: Yes.
Officer: That's not what it says on your licence.

Example 2:
Officer: Is the address on your licence correct?
You: No.
Officer: Here's a ticket for you.

Either way the question remains ...

Check out R. v. Andrews about having a passenger testify with contradictory evidence.

Also check out R. v. Stokes where the justice misclassified the charge as an absolute liability offence (very common mistake). It's also good for it's summary of the officer's testimony and evidence you should expect to be fighting.

When I was in high school I toured the parliament buildings. They had these little green buses that shuttled MPs and bureaucrats between buildings. When the bus behind wanted to go, they would just bump the bus in front. Hilarious. Don't know if they still do it or if anyone claimed whiplash by now.

Hold on a sec. No seatbelt (passenger) carries 2 demerit points and a warning letter from MTO for G1/G2 drivers. Why was her license suspended? Did you read the letter wrong or does she have other convictions?

I'm not that familiar with this area of compelling witnesses to attend court (my experience is fewer witnesses, better outcomes!). But here's a brief primer.

* A subpoena is a document that requires a person to go to court as a witness in order to give testimony.
