Re: Speeding 139 - June10 Court Date

Neo I hope you stick around after your court date to help others with their tickets. You're doing amazing research and have a great handle on the issues.

Yes, you need to provide copies of case law to the justice and the Crown. You will need to kill a small forest.

You have an excellent case for a stay based on non disclosure but you are out of ...

Re: self-testing devices

I did find some case law with respect to external testing that does not support this argument.

See R. v. Laarakker 2008

The heart of the issue is the defendant Laarakker did not challenge the officer's assertion that he tested the device in accordance with the manufacturer's instructions. We ARE CHALLENGING that assertion! The officer is not ...

Re: Disclosure Request

A couple of points. You may not always get the criminal record. It speaks to the credibility of the witness(es) but they may not have a criminal record! If the police did not note what the occupation of the witness is than they would not have that either. But they definitely will have the name and contact info.

Be extremely careful with the pre ...

I thought this was helpful: http://www.ehow.com/how_4449217_become-police-officer-ontario.html

Basically you need your COR and PREP. With that in hand you can apply to police forces. They won't look at you without these qualifications. Some police forces (Peel region) have made a strategic decision (blunder?) to only higher university grads. Keep ...

Re: red light camera offence ticket

Naomi,

The red light camea ticket goes after the vehicle plate owner. It doesn't matter who was driving at the time. The ticket is one of the more complicated tickets to fight. It also is one of the easiest to plead guilty to. It carries no demerit points, it does not affect your insurance and if you request a trial (option 3), go to court and ...

A couple of points on the Decatur Genesis VPD. You have to carefully read what is written AND what is not written in the manual!

Re: Cop suspended with Pay, HTA 172

I can't help but note the irony that the officer got to judge people at roadside and apply penalty. Meanwhile he gets the benefit of the doubt and time off with pay pending his court hearing!

I've observed OPP/police tows where the storage charge is $80/day. It should be around $20 so there's obviously some kickbacks in the system. I suspect this ...

Re: Bicycles and Drivers' Licences

I am not sure is if non-payment of a bicycle ticket leads to a license suspension. MTO will suspend a license if a traffic ticket (i.e. speeding) is unpaid. What were you convicted of?

Also is your question about not paying the ticket or not paying it on time? If you are stopped on a bicycle, you don't have to show your driver's license, just ...

Re: ticket for yellow light, cop didnt show

To request a stay you must actually make an application at least 20 days in advance of your court date. The justice may not grant you one. However, you can force an adjournment or a withdrawl. Refuse to accept anything from the prosecutor before trial if they try to hand you something. When it's your turn up to bat, state you did not receive ...

Re: Disobey Sign U Turn Section 182(2)

From your diagram it looks like you made a big left turn. A u-turn is a turn, made by a vehicle, in the shape of a U, resulting in a reversal of direction. You originally posted that you made a u turn. Did you? Did you completely reverse your direction of travel or did you make a wide coat hanger left turn? This makes all the difference.

And it ...

Increased Penalties

The fine for not complying with the Act or regulations respecting seat belts under section 106 is increased from $60 to $500 (the general penalty under section 214 of the Act) to $200 to $1,000.

The fine for careless driving under section 130 is ...

I'll try and explain your options as best as I can. But I warn you, it can get complicated and overwhelming.

Technically the wrong date is not a fatal error unless it misleads the defendant as to the date and location of the alleged incident. Are you misled about when and where your speeding occured? Didn't think so. So if you show up at trial ...

Stay Applications: 15 Days Notice Is Not Enough

I was in court last week and learned the hard way how to count. When making a stay application, section 109 of the Courts of Justice Act and section 4 of Regulation 200 apply. Specifically the first day, the last day and the court date do not count when counting 15 days. If the last day falls on a Saturday or a holiday, that doesn't count either ...

We haven't forgotten you. It's just that your post is a little more complicated.

First you can request discloousre at any point, and the earlier the better. Although it won't be ready in time you can still request it now. The court date will be to set a trial date.

The summons was correctly served. S. 26(2) of the Provincial Offences Act states ...

1. Request a trial.

2. Request disclosure.

3. (optional) meet with the prosecutor (a first attendance meeting) to try and REDUCE the charge. The chances of them dropping it are very low.

Just a couple of points. Disclosure is the sole responsibility of the Crown. While the Crown may delegate that responsibility to the police or another agency, the obligation for disclosure remains with the Crown alone.

So why was your co-worker requesting disclosure from the police??? It should never have been sent to them directly. (An FOI ...

Your ticket is toast.

Basically the sign has to be in French and English and in Toronto it isn't. That means the sign is invalid. But unless you know that, you will be ticketed and convicted.

So request a trial, request disclosure and prepare for trial. Here's the seminal case that started it all: http://www.yourbestdefence.com/illegal_street ...

The law changed a couple of years ago. Now all paralegals have to be licenced. As long as you are not charging money, you can represent someone else.

There was a grandfathering provision that allowed existing paralegals to write a qualification test. Now, every new paralegal must attend a 2 year community college set of courses and pass the ...
