DO NOT accept any papers prosecutor tries to give you. You do not want to receive disclosure 5 minutes before the court.

FYI, you CAN be arrested for missing a court date. It is not a threat.

Him not showing up does play well into your favour. It can help you plead down the fine if anything.

Received disclosier today via fax. Only thing there is officer's notes from ticketing officer. His notes state that a constable came to help him. Can i get the other guys notes? Or are there any? What if i want him as a witness? Notes are mostly legible, i managed to read it all. What a bunch of.... sigh..

Do you know how the officer looks like? You can look and see if he will shows up.

In your second request, did you specifically ask for the by-law? Typed version of handwritten notes? Then you can apply for a stay. Talk to the prosecutor, but don't let him know too much (or anything really).

Some people also reported that they were able to file for a trial up to a month after the date. of the ticket. Maybe this is why.

If you do not pay your ticket, you are deemed to be in disagreement with it. If you drove away instead of receiving it would be one way of it. The court has to go through all the unpaid tickets, and review them. If there is a flag that you drive away/weren't served, that might cancel the ticket for you.

You can always bargain with the prosecutor. Chances are your ticket will be dropped to 15 over, which is no points. Your insurance might go up a little, or it might stay the same. You will also get a rather small fine.

In the meantime, file for disclosure once you receive a court date.

Yes, it is possible to beat the ticket due to a cop no-show. You may also want to go some distance and request the disclosure (after you request a trial). Then you will be able to better bargain with the prosecutor.

Iwas caught speeding @54 km in a 40km zone. I have checked with my insurance company and my premiums will go up even if the offence does not carry any demerit points. My question is, when I go to trial would I be able to bargain with the prosecutor to reduce this offence for say a parking violation to be paid inmediately, or an HTA offence ...

Quite unfortunately, you could not prove that there was no by-law. However, this is not your responsibility. The crown MUST provide a copy of the bylaw that made the placement of the sign possible. Otherwise the ticket should result in "no charge".

You may want to file an appeal here, due to mistrial.
