Re: Question about fault: Failure to avoid a collision?
I would send the video to your insurance for sure. The other vehicle was turning into the spot then there is a chance they may assign some of the blame to the other vehicle.
Remember though that the insurance determination of who is at fault has absolutely nothing to do with the charges that were laid by police. They are two completely seperate ...

Did the officer see you, or did you get the ticket in the mail or delivered to you after the fact? If you got it after the fact, then it might already be a OWNER instead of DRIVER charge.

Is officer expert witness for radar/lidar testimony?
Just wondering whether an officer that is testifying about radar/lidar is giving "opinion evidence" and is considered an "expert witness"?

You probably got a SUMMONS? There is a date on it and you need to show up on that date and bring copies of everything showing your license was not suspended at the time.

The officers copy that he submits to court for filing is the Certificate of Offence, which is what the JP will look at. The copy that you get is called the Notice of Offence. Any other copies are irrelevent.

Re: exceeding speed limit by 15km/h-Trial or Pay?
In Ontario the courts have allowed officers to reduce tickets at the road side, and if you take it to trial and lose, then they will raise it back up to the higher original rate of speed. This is definitely NOT a defense in Ontario.

Re: Failure to stop at red light turning right
Therefore, I was going to go to court and ask for both violations to be thrown out based on the false charge and thus lack of credibility of the officers statements. However, I don't want to put forward this motion, if the judge doesn't agree and I'm denied adjourning the trial for the red light ticket. Any thoughts would be much appreciated.

You can not ever get a reduction in demerit points no matter what. Whatever you are convicted of will have demerits assigned to it, and those are the demerits you will get... there is no after the fact way to reduce them.
But remember that even a 0 demerit point charge can still cause increase in insurance as insurance companies do not care about ...

Just request the "notes of all officers involved" and the "make, model, serial number and manual of speed measuring device used".
They should send you the notes of both, as one officers needs to testify about your speed and about the device used and the other officer needs to testify about identifying you and about writing the ticket.

I recommend that you plead Not Guilty and request a trial with the officer present. Once you get your Notice of Trial, then you can request disclosure (officers notes and information about radar device used).

The reasons you give above in (1) and (2) are not helpful to your ticket at all... they are irrelevent.

You should ask for disclosure of the notes of BOTH officers. If one saw you and the other gave you the ticket, then they both need to testify.
The only way you can beat this is to NOT testify and NOT take the witness stand and NOT admit to anything and NOT give your side of the story. You have the right to remain silent and the right not to ...

Re: Charged as owner - INSURANCE/ABSTRACT
I can not answer your question directly, however since it was against the OWNER it should not show up on your driving record as you were not charged as the DRIVER.
The best way to confirm is go in to drivers license bureau wherever you live and ask for a copy of your 5-year abstract that insurance companies would get.

Get a letter from your insurance company stating that the car in question (make, model, year, vin) was covered on the day of the ticket, and this should be sufficient to get the charge thrown out. Driving with no insurance is something huge like a $5,000 fine so you definitely want to avoid this if possible.
