Re: 11B

Your delay can definitely get you a stay, just follow the guidelines in this thread: http://www.ontariohighwaytrafficact.com/topic2952.html

File the 11b app ~20-30 days before your trial date.

Re: 11B

The remedy for 'non-disclosure' is simple, you get disclosure. It appears the crown has satisfied their disclosure obligations?

What was the reason your recent trial date was adjourned? You have to give us a timeline of events.

Date you received ticket
Date you filed for trial
Date you received 'notice of trial'
Date you requested disclosure ...

Having looked through the Insurance Act, there doesn't appear to be exclusions w.r.t. risk classifications for suspensions due to unpaid HTA fines.

Re: Can I fight to get a suspension stricken from my record?

You would have received another letter prior to the suspension letter, which would've read, "pay outstanding fee by this due date, or else face a license suspension": http://www.wheels.ca/news/when-a-forgotten-fine-ends-up-in-a-licence-suspension/

Re: 182(2) for "no right turn on red" ? is by-Law needed? HE

Insurance companies can only increase your premiums based on HTA, CAIA & Criminal Code convictions. They can not increase your rates for by-law infractions, it most likely won't even show on your abstract; this again stresses the message that they don't care about demerit points whatsoever.

Points will stay on your record for two years from the ...

Re: 182(2) for "no right turn on red" ? is by-Law needed? HE

You have to exercise due diligence with your disclosure requests; it's in your best interest to request again for explanations for the short-form writing.

Forget the bilingual argument, Court of Appeals rejected the R. v. Myers decision.

The crown is not obligated to disclose the city by-law; you can get the by-law through the city: http://www ...

Re: Stopping inside intersection and making a left turn

Ok, got it. I have another related question as well: how many cars are allowed to wait inside the intersection on a green light? Up until now, I've thought that only one car should wait inside the intersection, while the rest should wait behind the cross walk. It depends on the size of the intersection and each vehicle; as long as the light is ...

No, and the consequences for not appearing in court is a $2000 fine and 30-days in jail. If you look at OPS Copper's post, you'll see that they take 'fail to appear' very seriously.

Re: Plea Bargain - Multiple HTA Tickets

What municipal by-law do you think is applicable with your charges? You will most likely have two out of the three HTA charges dropped in exchange for a guilty-plea on one of them.

You should request disclosure and see the officer's notes. With three tickets, make sure there are no 'fatal errors' on any of them: http://www.ontariohighwaytrafficact ...

Re: Speeding Ticket (possible fatal error)

It's your responsibility to contact the court house to monitor the status of your ticket. I don't believe they're lawfully obligated to let you know whether it's quashed by mail.

If you're convicted, they may send you a letter with a 'Notice of Fine and Due Date'. If you fail to pay, you'll receive a letter from the MTO that your driver's license ...
