Re: Ticket mistake?
Careless Driving is intended to apply to drivers' who's actions would be considered inadvertent or negligent. I wouldn't think this section applies to your situation. You conducted yourself in a purposeful way. No negligence was present. There are other sections of the HTA that would apply to your scenario. They weren't used. The officer was being ...

Already contradicting yourself here... you previously wroteMadCow wrote:Well the road was completely empty at that part, not even parked cars.
There is way more to this than what you are telling all of us.MadCow wrote:He checked no, even though there were 3 others in the car with me, and at least 20 others who saw what happened

Re: HTA 136(1)(b)
A ticket would not have 25km/hr on it. It must be from the Traffic Collision Report, where the speeds are usually obtained by asking the driver.

Re: Ticket mistake?
Another thing I don't understand is the "witness" checkbox on the ticket. He checked no, even though there were 3 others
In short it is a check box to let the person charged know that there either IS or is NOT a witness to the offence that could provide evidence for prosecution.
This box is used for collisions, where there is an "independant ...

Re: 12hr vs 3 day Suspension
So, that still does not answer the question of why do we need a 3-day suspension when we have not broken the law???? An "A" is 50-99 and the legal limit is 80?? Or is there more to this then is currently being told :| ???
Over 80mgs is absolutely breaking the law...Criminal Code 253(b)
There are other factors that are involved that politicians ...

I do not write down my full name either....first initial and last name only.MadCow wrote: Not only that, but the officer didn't write down his full name and miswrote the year of my car.
Some officers write down the year of the validation sticker in the "year" area, others write the year of the vehicle.

Re: HTA 144 (14)
You will have to challenge both tickets.
One is obvious...Fail to surrender permit.....this is immediately upon demand of a police officer....either you surrender it when asked or not
I am Not saying the officer is wrong, but my interpretation of 144(14) is when a vehicle is at a traffic control device (traffic lights) and the lights are multi ...

Too bad the plate wasn't more clear on the SUV...good evidence for a racing investigation there!!
That was very rude/ignorant driving, considering there was only one person going the opposite way.....even more so in small town nowhere, where most people know each other, great way so start road rage comments later amongst the two drivers.
Have to ...

Re: 12hr vs 3 day Suspension
I am still a bit confused....so you are saying that if in 1 hr some one drinks 3 standard beers, he would still be ok to drive with the 45mg/100ml of blood alcohol level?
Because I heard something about G license drivers can have up to max 1 standard drink in their system, and anything over that is against the law.
Can you possibly explain a ...

Here is a good reference guide, called a "Drink Wheel", you enter the required information and it will give you a result.

**admin** there is a link on the above site to show you how to add the "drink wheel" to a website, if you think it is appropriate for this site, for your consideration.

Re: 12hr vs 3 day Suspension
that would be 30mgs......then of course you have some elapsed time I'm sure in that consumption....ie 10-20min at least from end of first drink to end of 2nd, which also starts the elimination process as well

Re: Even the Police are not exempt
"Why do officers speed in a marked car without lights on?".
A lot depends on the traffic, and you are looking at me with 2 heads right now....sometimes it is quicker to go without lights on, people don't panic as much as they do when they see lights on......I have had people literally STOP on a live lane (passing) on the 401 with the lights on ...

12hr vs 3 day Suspension
***I MOVED this quote...as it does not fall under street racing*****
If the breatealyzer reads a warning you now get a 3 day suspension instead of 12 hour. I can understand the 12 hour but 3 days when no law was broken....seems heavyhanded. I'm all for safety but this is overboard.
I could understand 3 days if there is a breatealyzer [sp ...

Nah.. he just performed the standard "car guy" thing; accelerate hard(ish) through first, use up a bit of second, then let off. No high speed involved. Just getting that high you feel when pinned back in your seat for a second or too. If you're not into muscle cars, you'll never ...
