He was given two summons, one for stunt and one for speed because of the Rayham decision. Most officers were writing both while that case was being decided. This way if the stunt was deemed unconstitutional they could always fall back on the speeding. One will be dropped, likely the speeding.

Two cars were stopped for street racing in Windsor a while back too. Whats the big deal? They were both 150km/h plus too.
With Radar it might be easier but with if it was laser the accuracy is difficult to overcome.

The summons is in your wife's name because she is the owner. The biggest fine you could get is $65. Your wife however can be charged with permit operation of a motor vehicle on a highway with no insurance. But you got caught and got a break. Just because everyone else is doing it doesn;t make it right. Last time I checked the speed limit was 100km/h.

While the Raham decision was still being argued/decided, Officers wrote both speeding and stunt in case it was ruled unconstitutional. This way if it was decided unconstitutional (which it was not) then they could fall back on the speeding charge-otherwise you would walk off with nothing. Sounds to me like the officer got you at 125km/h and dropped it down to 115km/h for you. You yourself stated you weren't watching your speed so you really have no idea how fast you were going. If you fight it they will likely ammend the speed to the original (125km/h) and that will be twice the cost with 3 points if you lose.

If the officer laid the Careless charge, the prosecutor would have likely reduced it in any event.

Well "technically" a conviction would be a sure thing if you were driving. You'll have to come up with a reason how you and your car got on the side of the highway. So if you were driving, because you never clarified if you were or were not, its up to a JP to decide if your explanation is reasonable.

I would go with disobey stop sign fail to stop. I think disobey stop sign- stop wrong place would be reserved for someone that stops after the stop line in your example. Either way if this were to go to court its a 50/50 chance of conviction regardless of which charge you write. Frankly you could probably write either one.

Easiest in my opinion is to request a trial and not show up. The JP will quash it based on the incorrect section (assuming they are not asleep at that time)

How do you know thats what LIDAR the officer was using? If it was mounted on a tripod the range will be better. How the officer got you to pull over is not an area of interest to the court.
