You need to remember the Officers testimony does not have to be written on the ticket. It can come from independent recollection and if the SOP for the Officer is to test the radar at the start of every shift then why bother writing it down?

What information do you plan to gather from the manual of the radar unit and how do you think it will help ...

Blood tests are only done in cases where a physician says the subject cannot provide a sample (ie due to injury or if it would put the subject at risk). The subject cannot "request" anything.

I find it difficult to believe, in a City the size of Toronto that you are being "targeted" as you suggest. There has to be some reason you are continually getting stopped. It could be your driving, could be something you or your friends are involved in or any number of other things.

Funny thing, if your Dad's car was stolen you'd be pretty happy ...

Hi,
If you live in Ontario and your car is registered and plated in Ontario can you have insurance from a company in Michigan? Just curious if its legal since insurance is much cheaper there.

Ebike riders that got into Grandpa's cough medicine can and have been charged with impaired. Its a legit charge since its a motor vehicle as defined by the CCC. Since it is not a motor vehicle as defined by the HTA, ADLS suspensions do not apply.

It still needs to be towed from the road since you can't leave it there for someone to steal.

Many people get caught in an enforcement zone they KNOW exists. Was the officer using laser or radar? What proof or evidence do you want from the officer? The only evidence you're going to get is his/her statement that he pointed the radar/laser at your car.

Yes they can do that and do it all the time. A recent decision in the court of appeals upheld that ability too. So, either pay the ticket or take your chances.

Hmmm, I can't see them writing you a ticket using an expired licence. In any case you'll need to take it to court and explain what happened to the Crown. You may need a trip to the MTO for documention on when your d/l was expired.

I suspect the officers somehow found out you had an Ontario licence; possibly through a records check. You surrendered a Quebec licence but still had a valid Ontario licence on the system. I'm not confusing you and the OP. The OP should take the deal and you need to see if you can get the same. You can come up with any excuse but it doesn't matter. You need to pay your outstanding fines before getting a licence from another province.

Can't have a licence from Quebec and be suspended in Ontario without getting charged. Its illegal. If that were the case everyone would just go to another province and get a new licence.

The Officer didn't "have" to do anything. He could have let the guy go, he could have charged under 128, could have written a standard ticket for anything from 0-49km/h over or a myriad of other choices. Instead he takes a "regular" guy who met the magic target and BAM he's screwed. (I could care less he's a firefighter/chief)

Hi,
I'm curious how easy it is to get an appeal for a decision on a provincial offences matter. Surely ever area will be different but as a whole are most appeals granted or denied? Whats a viable excuse to get an appeal? Not for me, just discussion.
