Aftermarket mufflers.....

Hi,
I'm curious if those loud aftermarket mufflers they sell are illegal in Ontario. Is it officer discretion to determine what is "improper" or does there have to be some type of sound measurement done?

If I recall correctly you have 6 days to transfer the plates to the new car so the charge shouldn't have been laid. You'll need to bring proof of sale and make sure the dates are indicated.

Even if guilty, its only $300 and no points.

Just stay below 49km/h over the limit and you'll get to work just fine.

I like 172. Finally some legislation with some teeth. Thats just my opinion though.

I did stop but not completely

If you said that in court-you lose. The wheels of the vehicle must come to a complete stop. Slowing down doesn't count. Sounds like you slowed down.

Anyway there could be a number of reasons the officer told you to take it to court. I'm sorry to say, helping you out is not one of them.

You could have been charged with owner operate motor vehicle on a highway - no insurance or fail to surrender insurance card. The former is $5000 fine and the latter is $65. Either way you should have gone to the Police station to show proof of insurance.

See if you can meet prior to the trial (not the day of). This way they can cancel the officer. Walk in with your wife and humbly ask to plea to a lesser charge. Use her good record and remorse as a bargaining tool and make a statement that you don't want to waste any more of the courts time than necessary (you're time isn't important). They have a ...

You weren't charged with the curfew so no criminal offence. Provincial offences rarely result in jail time.

The best evidence that the Crown has of the 117 in an 80 is the radar reading. If the radar is not tested properly or is not used properly, the radar evidence should be excluded. You don't get arrested and have conditions placed on you for losing your licence due to demerit points. Conditions are for criminal offences so what were you charged with?

Misuse is about $300, no insurance (if you're the owner) is $5000 and violating your curfew is criminal so your penalty is up to the judge.

At this point there is nothing to lose by continuing to trial. On the day of the trial, a plea-bargain can still be used if you want to go that route

Cosine errors will only make the speed of your car slower, not faster. Your checklist is what the officer will testify to.

Do not believe the internet hype that you can easily win a speeding ticket. Its one of the tougher offences to have thrown out.
