Re: Would I get charged for stopping too close to stopped bus ?

Technically, you could. Will anything come out of this situation? Most likely not.

When meeting, you're supposed to stop before reaching the bus. You cannot proceed until the lights stop flashing or the bus starts moving.

The bus driver is supposed to continue with the stop until all passengers, receiving or discharging, have completed their ...

If you're moving faster than the posted speed limited, you're speeding.

Passing is not a defense.

If you get your sticker done, they may consider dropping that if you plead guilty to the seat belt charge.

Re: Hand-held ticket when plugging in at red light, officer rushed to deal with an accident during citation.

You have to be legally parked to handle your device. Stopping at a red light does not meet the criteria.

Whether or not you were using the device is also irrelevant. The law makes it clear that simply holding the device is enough.

You are not entitled to ask the officer questions roadside. The side of the road is not a courtroom. It's perfectly ...

Re: Date mismatches in the disclosure note ......

Notes are just something to refresh an officers memory.

You aren't winning a case based off a simple error in the notes. The officer will just correct himself and the trial will move on.

Re: What are the possible defenses to failing to stop at the nearest curb for an emergency vehicle?

I don't know if legal representation is all that necessary, but that's up to you.

I believe 159 (1)(b) sits together with the "move over" laws. 3 demerit points for those. The high fine is due to increased public frustration within the last couple years for drivers who are oblivious to emergency vehicles.

As per the officers notes...

The officer ...

Re: Question about licence suspension/interview/demerit point

The most important thing to deal with is the surrendering of the license (when he is issued a suspension), and the fee for the interview. Do not ignore these two things or it will make the situation way more complicated than it needs to be.

He'll have to pay another fee again to have his license reinstated after the suspension is served, which I ...

This forum deals with the Ontario Highway Traffic Act. The process will probably differ in Quebec as they use the Highway Safety Code.

When did you receive your tickets?

Have you asked for a court date yet? Are you waiting for your date? Have you received your date?

Re: Traffic ticket for not properly securing a seat belt

Who received the ticket for your wife?

Passengers over 16 are responsible for themselves. Passengers under 16 are the responsibility of the driver.

Are you sure your daughter received a ticket for seat belt under the arm? Is she in a car seat? Booster seat?

Here's the relevant section of the HTA which deals with your tickets:

How to wear seat ...

Re: Alleged STUNT and CARELESS driving. Never pulled over!

In a perfect scenario, the officer would pull you over and give you your ticket right then and there. However, it's their job to consider public safety and rules and regulations regarding high speed pursuits.

If the officer has your plate information, he probably has a brief description of the driver also.

While it's your right to not incriminate ...

Re: Appealing a conviction for a traffic offence where the ticket was not signed.

So if I understand you correctly you can't even look at your phone to see who is calling?

You can, you just have to have your phone mounted. There's also an exemption for pressing a button so you can make, answer, or end a call as long as it's hands free.

The problem is your phone wasn't mounted. One of the elements of the distracted driving ...
