Officers are in court almost always.
If you wait until your trial date to ask for disclosure, the delay is attributed to you , not the other way around. The responsibility is yours to request disclosure in a timely manner as requests may take several weeks to complete.
Even if the delay wasn't your fault to being with, you were only charged in ...

Re: What the rules are for Pedestrians, Roller Bladers and Cyclists at a 4-way stop?
Wow I didn't realize there were by-laws against cyclists on side-walks.
Usually, they are regulated by either age, tire size, or both. It'll depend where you live. You can drive to another municipality and the rules will change.
Peel for example regulates bicycles by tire diameter. Bikes with wheels 20 inches or less are permitted on the ...

Re: What the rules are for Pedestrians, Roller Bladers and Cyclists at a 4-way stop?
They are not the same.
A pedestrian is a pedestrian. At a four way stop, the rules are they have the right of way. They don't have to wait their turn, so to speak. This is pretty basic stuff here.
A bicycle is defined as a vehicle. You would treat them like any other vehicle on the road. In a perfect world, they'd stop at the stop sign and you'd ...

Re: TTC Bus Driving Straight From Marked Right Turn Lane
Some relevant portion of the Highway Traffic Act to consider is:
142.1 (1) Every driver of a vehicle in the lane of traffic adjacent to a bus bay shall yield the right of way to the driver of a bus who has indicated his or her intention, as prescribed, to re-enter that lane from the bus bay. 1994, c. 27, s. 138 (12).

Re: ticket for use of hand held communication device
my main question how is it possible for a cop to confirm in court that you were in fact using a hand held device?
At the bare minimum, the law only requires you to be holding the device.

If we're indeed talking about a red at an intersection, your son is correct. There are only two exemptions for proceeding.
Red light

Re: Hand held device ticket on Gardiner Expressway
They are not dismissing this charge out of the goodness of their heart. In fact, I don't believe this is a charge they even reduce since there's no relevant lesser charge.

Re: Hand held device ticket on Gardiner Expressway
In this scenario, it will be likely that the officer will say they saw you handling the device. That would be all the proof necessary for a conviction in most cases.
The officer would have wrote notes with the details of your stop. If you request a trial, you can make a separate request for the notes and they will be made available to you.

Re: Posting for my Daughter who just received a careless driving ticket.
It would be your daughters responsibility that vehicle she is driving is mechanically sound and fit for the road.
Realistically, you should probably find out if a deal can be made for a less drastic charge at an early resolution. Literally anything will be a major improvement.

Re: Hand held device ticket on Gardiner Expressway
Your call logs wouldn't be considered.
You only need to be holding your phone for a conviction, whether you're using it or not.
So however you proceed going forward with your ticket, the argument will be whether you touched your phone or not.

Re: Speeding ticket 40km/h over limit - GUELPH hwy 6
I have had a friend go in with a 40 km/h charge and they dropped it to 29km/h and therefore eliminating the 30 day suspension. I was confused because ive heard they can do relatively nothing but wondering if it was something that could still happen if I attend this meeting.
Having a ticket reduced from 40 to 29 is one thing. It's pretty common ...

Re: Could you please advise how to file for an appeal from Ottawa?
As Decatur said.
You can go to court where the trial took place and they'll give you a simple form to fill out. If I remember correctly, it's just a sheet asking for your general information and a section asking your reasoning for filing an appeal. There might also be something about transcripts and a small down payment.

Re: Reduced 119 kph in a posted 80 kph - construction zone
I also just looked over it, I don't see anything that would say a construction zone would fall under a major offense. but anything involving schools or school buses would bump up a normal offense to a major offense. School zones, playground zones, school crossing signs, school bus passing/stopping, etc. Nothing specific to construction zones, but ...

Re: Failure to Provide Proof of Insurance Plead Guilty with Excuse
You are charged with not providing proof of insurance on demand when requested. Even if you get a hold of your current insurance slip after providing the incorrect one, the officer is not obligated to go back and forth with you. It would be considered your duty to provide it the first time, which you should consider the only time.
