I don't want to be forced to go to trial, but if the officer doesn't show
or there is some other reason that the charge gets dropped I don't
want to stop it from happening.
Lots of prosecutors won't let you on to the fact that the officer is either there or not. Just because the officer is not in the courtroom doesn't mean they are not in the ...

Re: 15 days to select option
Hello all,
In revieiwing some of the forums, I have come up with a question - it is not specific to any circumstance, situation or forum, but just a thought. From what I understand, an alleged offender has 15 days to select one of three options when a ticket is issued. An officer has seven days to submit his/her report/paperwork/tickets. Many ...

Thanks for the reply. You seem to know what you're talking about.
Actually, I just checked my ownership document, and although my car is dark metallic green, it says "GRY" on the ownership. DOH!

Re: Fail to obey stop sign HTA 136 a (with video evidence)
All I'm telling you is I've never heard of it. The officer would have to have enough evidence to proceed with a charge. The system allows you to challenge that in court. We have many policies and procedures but not for every conceivable action that we might take. That's where common sense comes into play.

Re: failure todrive in a marked lane charge after crash
- You are to drive according to the weather conditions. Wet roads aren't an excuse to get into accidents, or in your case, drive into a ditch.
- What the driver does in front of you is irrelevant. You are to leave enough space in front of yourself and the vehicle in front of you so you can come to a full stop. Since you had to put the car in a ...

What exactly did you hit? Was it one of those concrete/steel posts (bollards) they put up to keep you from accidentally driving into their equipment? If so, I'd highly doubt they are going to waste their time pursuing this.

Adding further, devices are to be mounted or securely placed in your vehicle for button access. Using a headset that requires touching to turn on is also OK. Holding the device in your hand, if that's what happened, is going to be another argument against you.

I feel like being honest and showing the judge that my case is unique might be the better bet.
Your case is not unique. There's nothing unique about using a cell phone while sitting at a red light. Putting your vehicle in park has little meaning because it doesn't sound like you were either off the roadway or parked lawfully. Could you get out ...

G2 license is nonrenewable (unless you received your G2 4+ years after your G1 and have less than a year remaining to exit out of the class). They will also offer temporary license extension to those who have scheduled a road test just after their expiring date. If not, you will have to reapply for a G1. If you do it within years of expiring, you ...

- He never stated any other repurcussions. I was not told (as I understand the HTA) that if guilty I lose my license an additional 30 days. I am also unclear whether I have to 'start over again' with a G1...?
If a novice driver holder (G1/G2/M1/M2) is caught with alcohol in their blood, the driver will receive the following penalties:

-Do insurance companies check driver records at every renewal?
This really depends on the insurance company, but usually not. You can go a whole 3 years before they ever check again. People usually say unless there's been a lot of activity (e.g. New cars on your policy) they don't check. I'd probably think it's just more random than that. I ...
