Hi,
I just got into a collision on a road. Both vehicles were attempting to back onto the same road (both heading west) from opposing driveways. My vehicle was backing up onto the road from the far side of the road and the other lady's vehicle was coming from the other side of the road.
The police officer came and assessed me at fault on the ...

Re: New York to Ontario Abstract
What you linked to were offenses that carry demerit points. These will transfer to your abstract as if you committed them in Ontario. If the out-of-province traffic act calls for more/less points than the equivalent Ontario HTA offense, it won't matter here. If the offense is 4 points in New York and 3 points in Ontario, you'll have 3 points on ...

Re: No radar in sight - Should the officer have shown me?
No, there is no rule in Ontario that says the police have to show you the radar gun. Some police officers will show it to you as a courtesy but they don't have to, so the fact that she didn't in this case won't help you in court.
The poster says he never saw a radar gun?
I wonder about that, How can speed be determined.
I know the cops hide but ...

Re: Grounds for an appeal?
I'll let someone who can give you a more detailed explanation answer your questions, but if you're going to file an appeal, make sure you are committed to it.
For example, you'll have to pay for your trial transcripts to be typed out and printed for you. Price varies, but they aren't exactly cheap.

Re: alcohol dependence - suspension... PLEASE HELP!
There's some people who can explain this here better than I can, but I'll fill in some of these holes in the meantime. These medical reports are filed because there is a concern that you may be a hazard medically to be on the road. The hazard is that you have these blackouts. You need to see a doctor who can confirm you are fine to drive, that it ...

I'm guessing them telling him to seak legal advice first means he is in a great deal of trouble?
Not always. If someone gets something as simple as a speeding ticket and they are rather overwhelmed in court, they will sometimes give them more time to seek advice. They don't want confused people pleading out of confusion. It doesn't necessarily ...

1.) What should I do about the disclosure issue? Should I talk to the prosecutor before hand or should I declare that I did not receive the video evidence during trial? Also when should I make that claim about disclosure to the Justice of the Peace? and how should I say it to the judge?

Re: Got ticket for 4 people in the backseat: 106(3)(a)
I got a ticket for $240 for being a fourth person on the back seat of a full-sized sedan equipped with 3 seat belts (HTA 106(3)(a) failed to occupy a seating position for which a seat belt assembly has been provided). For some reason the cop decided to pick on me and not the other three people in the back. I was occupying a sitting position just ...

Re: Failure to obey stop sign
An officer on the traffic unit pulled me over today and said that I had failed to come to a complete stop at a four way stop. He pulled me over a few hundred meters away from the stop sign. When I was asked to provide proof of insurance, I felt that I was not given an ample opportunity to access the information as it was misplaced and there were ...

Re: Points erased, insurance still increased??
Demerit points is a Ministry of Transportation penalty system to help promote safer driving and to penalize those who are too reckless. They mean nothing to insurance companies. Insurance companies don't look at your points and they don't care about your points. Points stay on your record 2 years from the date of the offense, not the day you were ...

Re: Listening to police scanners online
If you're looking on listening into local scanners, the easiest, convenient, and most useful way to listen to police scanners is through your smart phone. They have a couple apps that will do this in the Google Play Store on Android devices. I'm not sure about the Apple Store.

Re: Careless Driving ticket, Dirfting.
I don't know what the Alberta Traffic Act says about Stunt Driving, but the other posters here are correct.
In Ontario, the officer would be cutting you a big break by issuing Careless Driving instead of Stunt Driving. Not to say Careless Driving isn't so bad, because it is, but it's way better than dealing with a Stunt Driving charge.
