If they dont provide disclosure its not your fault. You must bring proof that you have requested it. Hopfully you sent registered mail and have the signature reciept for each time you sent request.
You should at the very least get an adjournment for another court date. This will be the fault of the crown, and if the delay from the time you were ...

Re: requested disclosure 6 weeks ago, not received, court tomm..
I actually requested disclosure at the court, so I have a piece of paper with a stamp from the court that shows they received it.
Awesome.
The reason for the first adjournment was because my paralegal guy was unable to make it due to illness, so I do not think I can file for an 11b yet.
Ouch! I think that goes against you. I hope you ...

Re: requested disclosure 6 weeks ago, not received, court tomm..
Absolutely IMO. Maybe try asking to have the charges dropped because of it. Likely they will just adjourn at that point. But have the proof that you sent the disclosure request. You sent registered mail right? so you have a signature of someone who recieved it, right?

Re: Hydroplane into ditch, careless charge
Ya the police just want some money for responding to the scene. I guess the tax increaces arnt enough. They lay careless charges to easily. Glad you didn't have to pay. So Can you fill in the blanks as to how the charge was dropped?

Re: Summons to appear ?
It makes no sence to me. CAreless is a heavy charge. zero dollars as a fine and zero points does not add up. Are you sure YOU have been charged? or do they think you were a witness to the charge? I have recieved a summons as registered mail to apear as a witness.

throw in something about a big insurance increace that has hit you hard, so you cant even afford another ticket and will drive safer if you have it back.

Re: Fail to stop - the stop sign was not visible from 60m
sometimes I have seen a "stop sign ahead" sign. Its a yellow sign with a pic of a small stop sign and an arrow on the top. Does that void the 60m thing, I dont know. But if theres not one there that you should be golden.

PAralegal said plead it out? Seriously dont pay for this guy. you can plead it out easily yourself, the prosicution will usualy offer something as a deal.
Ask your paralegal "If I stopped legaly, (ie your innocent) then why would I plead guilty to anything?"

Re: can i be charged with DUI if...
That really sucks big. How can they do that? you cant separate the D from the UI can you? Ok so Is it because the keys are in the ignition? If the keys are in the house would that be different?
Also if at all posible could someone show me the part of the HTA that says that?

I was surprised to learn that there are certain laws in the USA that a person can be charged with DUI if they have been drinking and sitting in the drivers seat with keys in the ignition, but not actualy driving.

Re: Can the HTA be enforced in a mall parking lot
Plus insurance blame is different than HTA blame. You can be sure that if you are not stopping at a stop sign and cause a collision you may not get a ticket. But the report will reflect that you are clearly at fault. In my experience you will be blamed fully for the collisions.( this is from a personal collision I had in PVt property. Other guy ...
