4. A certificate of offence shall be filed in the office of the court as soon as is practicable, but no later than seven days after service of the offence notice or summons. 2009, c. 33, Sched. 4, s. 1 (4)."

I don't know if that's an automatic dismissal though.

I feel if he had a soul he could of told me all the rules and I would of never did this again and perhaps he could of suggested we drive over to my place 3 minutes away to fix the problem by getting my papers into my wallet from my room and giving me a few hours to come back to meet him at the station showing I went to get new sticker. You don't have to disclose anything. The burden of proof in a trial lies with the Crown.

Plus when I pull someone over I don't just affect that driver but everyone else on the road who sees the flashing lights. I live in the UK now and almost all enforcement is by camera and people see the ticket in the mail simply as a cost of doing business.

P.S.: In this case, yes! Some neighbours saw me measuring the street and came over to chat, and it turns out she monitors the mailboxes (also on the private street), and has threatened to give people tickets while they were getting their mail.

Then they should be filing a complaint against her.

If you are inside for 5 minutes then you are parked. Basically if you aren't around your vehicle then you are not actively engaged in loading.

PS. Vulture ? You mean the person who helps to keep traffic flowing and routes open for emergency vehicles. They came across your car unattended and did their job. If you did not see them then how can they ...

You need your licence to drive. An officer might show discretion but then again we've heard every excuse in the book. Just the luck of the draw which copper you might get.

If you got a ticket it would be an offence and would count against your insurance.

Simple answer is don't drive until you get a new one.

The copy of the form that goes to the ministry (and later the insurance company) has codes on it where the officer should have indicated it was a Fail to Remain. Your copy won't show those. They will mail a letter of suspension to the address on file with the MTO. The suspension then comes into effect a certain number of days after that. It's referred to as 'deemed service'.

I'm not sure it's going to be that simple. If the actual certificate of offence isn't signed then that would be one thing. I don't think not having a signature on the Offence Notice is necessarily a slam dunk. It may be but the court may not see it that way. The notice is to advise you of the charge, which it does even without the signature.

I stand corrected. I read it the same as jsherk. I always pulled the Offence Notice off and signed both parts separately.
