Tell him to call the police, and your insurance company but fire off a letter to the insurers with the background of the incident.
This sounds like a fraudulent claim.

They wouldn't say anything but they keep the records of what happened in court. They will write notes on each matter so the justice can know what went before.

I don't mean the desk clerk, I mean the court clerk in the court room adding notes to the jacket depending on what happens that day.

I don't know for sure but one would think that the court clerk would have records of the outcomes of each appearance and the reason for the delay.

Re: Form 4 Offence Notice - content
Ah were closer together than you might think. I've always said that the entire HTA should be thrown out for just one offence - driving like a moron. Then it would be up to the officer to present why the driving behaviour was a problem. I have seen officers sit in the 'fishing homes' and I agree that it is nothing but a cash grab.

Re: Form 4 Offence Notice - content
You come at this from the point of view of a law-abiding citizen dealing with minor traffic matters. Misleading and, yes, lying when trying to gain evidence against some of the most heinous members of our society is a critical part of criminal police work. Don't forget that the same police officer who may stop you for a burnt out tail light could ...

By the way, jsherk, I have noticed you do a very good job of avoiding getting into 'flame wars' in threads and that is admirable. But know that if I disagree with you, it is on a factual basis and nothing personal. I do and have always enjoyed discussion of differing opinions so don't be shy to come back at me - I won't take it personally. We all ...

I do get why you consider it a win but really you get the result you want by being a bigger pain than the crown is prepared to deal with. Certainly you get the result you want but it isn't that you actually win your arguments.

If the court don't have any record of it then I suspect you got a freebie. The officer either lost his copy, or noticed a fatal error, or something else. If he didn't submit it in 7 days then the ticket is no good so he'd have to do a summons. Very unlikely.

But, based on the possibility, I'd drop the $25 and be sure - although these things can take time to hit the system.
I can't imagine how one would need to get a Canadian pardon for an offence that wasn't committed in Canada but I ...

I don't think that misleading is what you need to look for. You need to get the justice to agree that the sign doesn't match the requirements of the regulation. If they do then the sign is invalid. Personally I don't see it but keep us posted.

To have a criminal conviction in Canada you'd have to have been found guilty by a Canadian court which you were not. The penalty is an administrative one based on reciprocity.
You do not have a Canadian Criminal Recird but you couldn't answer no to the question have you been convicted of a criminal offence.

What if the crown/police doesn't have a digital copy but only a paper one ? You are now asking for disclosure of something that they do not have.

How is it a cash grab having signs that indicate what speed you should be going ? The warning signs are a courtesy to allow you to slow your car down to the new sped limit ahead which is in effect when you reach the sign.
A cash grab would be if there were no warning signs.

The case above only orders the disclosure of the testing pages, not the whole manual as you would like:
"Therefore, it is hereby ordered that the prosecutor provide by way of disclosure in the matters of Mr. Rose and Mr. Millar, photocopies of the pages of the Genesis II Users and Installation Manual relating to testing procedures and operation of ...

That's a pretty big allegation to say the officer is lying. Do you really think he or she is going to fabricate a speeding charge and jeopardise a $100k a year job just to issue you a ticket ?

The fact they have lights and sirens on does not mean they can fly through red lights. It is their responsibility to make sure their way is safe.
