Typically left turning vehicles must yield to through traffic, but stop signs work a little bit differently. Heres the section covering stop signs and right of way from the Highway Traffic Act:
Stop at through highway
136. (1) Every driver or street car operator approaching a stop sign at an intersection,
(a) shall stop his or her vehicle or ...

Re: Disobey signs changed to Park or Stand on Highway
Was the charge you plead to under the Highway Traffic Act or a local bylaw? Theres a charge for parking on the highway under section 170 of the H.T.A., but theres also typically bylaws that would cover the same offence.

Re: Regulations regarding speed limit signs
Speed limit signs are covered by regulation 615 of the Highway Traffic Act here: http://www.canlii.org/en/on/laws/regu/rro-1990-reg-615/latest/rro-1990-reg-615.html
I don't believe there is any requirement to post a warning regarding speed limit changes. There simply needs to be a posted sign advising of the new speed with "begins" below it.

Re: Ticket for 78 kms/hr at 50 ft before the 80 kms/hr Post
I agree that most drivers speed up ahead of time, but that that isnt a valid defence in Court. If you said that in Court, youd be convicted. In terms of fighting the charge, its probably best you read through the forums and get some ideas on general strategies for fighting tickets. Its always a good starting point to request disclosure and see what ...

Well Im not Simon, but I think I can answer your question.
For most police services, HTA matters are always scheduled on the officers regular working days. Courts are provided with a copy of the officers schedule (including vacation days) so that they know when to book matters. Matters can be delayed or rescheduled, but the Court will typically ...

Yes, the bike lane would be no different then a second lane for regular motor vehicle traffic. In your scenario, the cyclist would have right away.

No, that specific argument would not be a valid defence in Court. Legally, youre required to obey the 50 km/hr limit until you enter the 80 km/hr zone.

Re: 46km/h reduced to 35km/h...what do I do?
So I really shouldn't even bother fighting it?
I'm not saying that, but it might not have the impact on your insurance that you first thought. All tickets can impact your insurance rates, but a major conviction is much more drastic.
And yes, the prosecutor will likely know your ticket has already been reduced. Although the officer didn't mark ...

Re: 46km/h reduced to 35km/h...what do I do?
From what I've heard, 35 over is considered a "Major" violation and will most definitely increase my insurance. I know I made a mistake, and am willing to pay for it, it's just that it will affect my grandparents insurance as well since we are all insured on the vehicles in our household.
I'd check with your insurance provider on that. Some ...

I agree the total payable shows $355.
The online fine payment system may be somewhat automated, where a clerk just types in the speed and the computer figures out the correct fine.

Any conviction for which you were charged as the driver should show on your abstract, not just those with demerit points. And unfortunately insurance companies look at all convictions, not just those with demerit points. Assuming its your only conviction, it should have minimal (if any) impact on your rates.

Re: Fatal Error
For what its worth, in my 10+ years Ive never once seen a cross street listed on a speeding ticket, nor have I ever heard of the Courts having an issue with this. And with all due respect to the retired JP you spoke with, I cant see their suggested argument holding any water in Court. I really dont see how you can argue when the street and city are ...

Again, if you go to trial the error can be corrected. Probably your best approach would be to force a fatal error based on the incorrect fine.

Re: Was the copy giving me a birthday present?
My fine sheet says it would be $359, which I think is correct. I'm wondering if they made a misprint in a batch of notebook companions.Decatur wrote:2) Just looked in the notebook comanion and the set fine for 49 over is $249 and the total payable is $355.
Base fine is $294, victim surcharge is $60 and court costs would be $5.
