Re: plaincloths officer stopped me for not checking

If this was an auxiliary, are they always "on-duty" like a regular constable is? I think I remember a few getting in trouble for taking the "tin" from their hat and putting it in their wallet to flash around.

Don't worry, my guess is that one of the admins/mods did it by accident. They have an "Edit" button for every post on here which is right next to the "Quote" button.

Thank you HwyBear.... the word Ontario could clearly be read in this case...just tip of the letters was covered by dea;ership cover .

Re: "improper use of headlights"

Do you remember what the charge was? I wonder if anyone has actually lost a court case for this under an "alternating lights" charge. Would that set a precedent for this alternate (ha ha, pun) interpretation?

To me, that section prohibits flashing highbeams where the beam alternates between the left and right lamps (i.e., left on, right off > left ...

Re: obstruct plate

We have an old plate that holds sentimental value (first plate ever issued) and we did get a warning about the rust, but no ticket. I have since cleaned up the majority of the rust and moved the worse of the set to the front, but now the paint looks very faded, though still legible. I'm also curious if non-vanity-plates can be replaced, and whether ...

Re: Using Centre Lane Improperly

154 (1) (b) applies only to a three-lane road. You were on a five-lane road, in which case you can argue that this clause neither prohibited nor allowed your actions (with strong emphasis on "did not prohibit").

I'm not sure if they can turn around and issue a new ticket, though.

Re: Using Centre Lane Improperly

I think the wrong clause was cited. From what the officer seems to think you did, (c) looks like the correct clause - official signs (or lane markings) were present indicating that the centre lane is only to be used as a turning lane.

I'm not entirely familiar with that area, but I think it's actually a five-lane road - a centre lane with two ...

Who words these things? Is it just carried over from the proposal, or is there some guy who spends his life writing the HTA?

Sounds like someone got carried away with the media hype over our new "street racing" law. Then again, what should 172 be called? The "racing/stunting/wager" law?

Re: "G1 unaccompanied by qualified driver"

Ask your friend to look at his license - the older purpley trillium license would show four white dots on a red strip under his picture if he is qualified to accompany a G1 driver. I think the newer design shows four black dots on a vertical line beside the picture, but I'm not sure.

I don't think G2 drivers may accompany a G1 driver as they are ...

Re: Case Law Update

I don't think the semantics of the heading matter. "Every person who commits an offence" would be all-inclusive. Now if it read "Every person who commits an offence under section 130, or an offence of racing under section 172, in a community safety zone when it is in effect..." then you would be off the hook for 50-over.

We once owned a retail store, and sometimes there were thefts, but the Police told us to never touch or go after the alleged robbers, or we could face assault charges or other problems. They wanted us to simply call the police and they would handle it!

Re: "improper use of headlights"

Some officers will mistakenly charge you for producing "alternating flashes of light," which is reserved for emergency vehicles.

I don't know of any law prohibiting such an action during the day, but it is illegal in conditions where headlights are required - can't use high beams within 150 m of oncoming traffic.

Re: Correction for posting, is this law 6 years old

The law doesn't require drivers do it at any cost, it only requires it to be done if it can be done safety.

Right. Taking Bondra's side of the story (and I have been in that circumstance before), I would slow down to ~20% below the limit and turn on my four-way flashers to let the officer know that I am aware of his vehicle. Never been bothered ...

Re: Correction for posting, is this law 6 years old

Bondra12 was in the same lane to begin with, but moved into an adjacent lane to comply with the first scenario outlined in subsection (2). They then fell under the second scenario, being in an adjacent lane, and the law applies once again.

I also disagree about it being a money grab. It's about minimising risk to the officer - if room is available ...

Re: Impaired boating

The HTA can't apply to boating, can it? Thus wouldn't any suspension under the HTA mean nothing to a boater? They would have to amend some act that applies to the waters to make the PCOC invalid with a supended driver's licence. I'm guessing that would be done at the federal level, as the PCOC is (almost) Canada-wide.

Now I think your driver's ...

The definition of a 'motor vehicle' seems pretty inclusive to me. The "any other vehicle propelled or driven otherwise than by muscular power" (to me) would include the motorised rollerblades and the gravity-driven bike.

The definition does not state that the vehicle must be solely powered by a means other than muscular power, just that it is ...

Re: Reporting hit-and-run

Got my estimate today: $701. That's just blending in the paint to the corner of the bumper, which doesn't involve the existing damage, so there's no need for me to pitch in. I might negotiate with the insurance company to have them repaint the entire bumper, and I can cover the prepwork costs in order to have a "perfect" job done.

Re: Interpretation of Ontario acts

The way I see it, any electric bicycle meeting the current definitions as a "power-assisted bicycle" falls under 473/06 (for now), which exempts it from "motor vehicle" status. Something outside of those definitions (e.g., modified to have a higher top speed) would no longer be subject to that regulation and the exemptions, and thus get bumped up ...

Re: Interpretation of Ontario acts

Under O.REG 473/06, an electric bicycle ("power-assisted bicycle") is no longer a "motor assisted bicycle" or even a "motor vehicle" with regards to riding it. However that bike must be limited to 32 km/h, or else I think it gets bumped up to "motor assisted bicycle" and "motor vehicle" status.

A power-assisted bicycle thus requires no insurance ...

I agree with cruzmisl. No one was protected or safeguarded by seizing that vehicle. 49 km/h over has serious enough consequences.

I got an e-mail from the insurance company saying "the repairs process has started," which was kind of ...
