Re: Hit by other vehicle while turning permitted left turn
With no collision coverage, you have to repair it yourself. As for claiming medical expenses, you'll have to talk to the insurance company. Without seeing the policy and what it offers, I really can't tell you much. They should offer something, but I can't say for sure if that's the case, or what they would offer. For 3rd party coverage, unless ...

Since it's Toronto, it might take a wee bit too long for them to bring the case forward. If your trial date is more than 12 months from the date of the offence, you can file an 11B motion to get the charge thrown out. It's possible, but definitely keep the plea-bargaining option as your main course of action here. (And once you get your trial date ...

I would add that they have up to six months from the date of the offence to amend your charge BEFORE the proceedings start. Once the proceedings start, the Justice of the Peace and the Prosecutor cannot amend the charge. The only exception is for speeding, where the officer reduced the ticket at the roadside. Because speeding is still speeding, and ...

Talk to the rental car agency and advise them that you plan to fight the ticket. You'll likely have to coordinate with them with regards to the parking ticket.

Re: asked for adjurnment, can i still do 11B?
For the delay from April 28 to May 25 of the next year (more than 12 months), that should be enough for an 11B. However, since you asked for an adjournment, the time from May 25, 2011 to November, 2011, will not count for the 11B application.
The 19 months should be enough for an 11B as well.

Were you charged with anything?
If not, if you were turning left and the other driver attempted to pass you and nailed your car at an intersection, then he is 75% at fault for the collision and you are 25% at fault. This is under the Fault Determination Rules of Ontario, section 18 (5). If you were attempting to turn left into a private driveway ...

$1000 for a white mark on a tire? That is complete horse s***. I agree with Cormacs, it sounds like this guy is asking for four brand-new, high-end tires. Tell him to get a quote, from an approved repair facility, and you will go and pay the repair facility yourself (also be sure to talk to the mechanic at the repair shop to see what kind of damage ...

The particular electronic method you mentioned is not available in your case. The courts in Ontario (well, except maybe those responsible for the Hudson Bay coastline) require someone to go there in person.

Compensation? Well, he'll have to get you a quote for the damage done to his vehicle from an approved repair shop. White marks on the tires only don't really warrant much of a claim, unless he needed to replace the tires. See what he says first. You have up to 7 days from the day of the incident to file a claim. Technically, though, there was no ...

Re: Speeding - 120km/h in a posted 100km/h zone - no radar..
I suppose you could argue that in every speed-measuring device used by police in Ontario, and supported by case law such as R. v. Vancrey, R. v. Schlesinger, etc., the device had to be tested and shown to be working correctly both before and after the stop. Unless there is some sort of proof that the speedometer was working before and after the ...

Agree with Stanton. The way I see it, it looks like the officer was actually being lenient by charging her with "failure to report." It could've been worse. I suppose you could ask for a reduced fine in court, or possibly try to plea-bargain to a lesser charge. Technically, a report was made, but it was a false one. See what X-Copper says.

That would also be illegal: Failing to keep right except to pass (which is true in almost every US state as well). Doesn't matter if he's at the limit; if he's not passing, he's not allowed to be in that lane.EphOph wrote:If the "slow" car was traveling at the speed limit he should have moved right back over behind the cop.

The only way for the points to be removed is for a conviction for 15 over (or less). The courts do not have control over demerit points. At 29 over, you'd get 3 points. The points are an administrative action applied by MTO after the conviction. Keep calling around for a quote and see what they'll do for you. For the validation sticker, there is no ...

Usually the police would seize the detector and give you the $170 fine. (I believe they're supposed to seize the detector, but that won't get you out of trouble here.)
If you pay the fine, because Illinois does not have full ticket and licencing reciprocity with Ontario, the matter simply "disappears" and the Illinois DMV would never hear about ...

If you plea bargain they might lower the speed to 29 over, or they might even drop it to 15 over if you also plead guilty to the validation sticker offence. All depends on the Prosecutor.
FYI. As hwybear says, the officer does not have to show you the radar reading.

Quebec applies demerit points based on its system, not Ontario's. So if you get convicted of a 32 over in Ontario, you would still get 3 points on your Quebec licence. Likewise, an Ontario driver convicted of 32 over in Quebec would get 4 demerit points applied to his/her Ontario licence.

Provide the proof to the officer and see what recommendations he makes to the Prosecutor. 11 months is generally not enough for an 11B, though. Usually you have to cross the 12-month line from the day of the offence. In your case, though, the delay was charged to the Crown for failure to provide disclosure (assuming your requests were proper).

In this instance, the vehicle's owner (if the offence got reported) would be looking at a $490 fine, no demerit points, no insurance increase, nothing on the driver abstract - just the fine.

Re: Ticket for 3M from the Hydrant...but it is 5 meter actua
I'm pretty sure it's 3 metres either side of the hydrant on the roadway. The fire truck has to be able to park as close to the hydrant as possible, so having a car there would obstruct the firefighters. I could be wrong about how the by-law is worded, but like I said, I think the ticket is correct based on the description given.
