Re: Hit by other vehicle while turning permitted left turn

With no collision coverage, you have to repair it yourself. As for claiming medical expenses, you'll have to talk to the insurance company. Without seeing the policy and what it offers, I really can't tell you much. They should offer something, but I can't say for sure if that's the case, or what they would offer. For 3rd party coverage, unless ...

That's a great idea. He gets charged for Following Too Close, and you get charged criminally for Dangerous Driving. People who brake-check other drivers and cause crashes usually get charged criminally, and get convicted. But, since it was in the US, instead of Dangerous Driving, they'd probably use a charge like Reckless Endangerment or ...

If you were turning into the medical building, the Fault Determination is 50-50.

Re: 83km in a 60km

Since it's Toronto, it might take a wee bit too long for them to bring the case forward. If your trial date is more than 12 months from the date of the offence, you can file an 11B motion to get the charge thrown out. It's possible, but definitely keep the plea-bargaining option as your main course of action here. (And once you get your trial date ...

Re: Charged with HTA 136(1)(b)

I would add that they have up to six months from the date of the offence to amend your charge BEFORE the proceedings start. Once the proceedings start, the Justice of the Peace and the Prosecutor cannot amend the charge. The only exception is for speeding, where the officer reduced the ticket at the roadside. Because speeding is still speeding, and ...

Re: Parking Ticket with rental car

Talk to the rental car agency and advise them that you plan to fight the ticket. You'll likely have to coordinate with them with regards to the parking ticket.

Re: Sign/License Charges

I tried to create a new thread, but it got added to my old thread.

There's a few reasons for that:

1. When people are trying to follow your story, chasing down multiple threads to get the big picture makes it much more difficult.
2. Without the full picture accessible to them (ie. one thread), people are likely to give you incomplete ...

Re: asked for adjurnment, can i still do 11B?

For the delay from April 28 to May 25 of the next year (more than 12 months), that should be enough for an 11B. However, since you asked for an adjournment, the time from May 25, 2011 to November, 2011, will not count for the 11B application.

The 19 months should be enough for an 11B as well.

So did this collision happen in a parking lot or did it happen ON Tecumseh? Big difference between the two.

Re: Hit by other vehicle while turning permitted left turn

Were you charged with anything?

If not, if you were turning left and the other driver attempted to pass you and nailed your car at an intersection, then he is 75% at fault for the collision and you are 25% at fault. This is under the Fault Determination Rules of Ontario, section 18 (5). If you were attempting to turn left into a private driveway ...

Re: be asked for compensation

$1000 for a white mark on a tire? That is complete horse s***. I agree with Cormacs, it sounds like this guy is asking for four brand-new, high-end tires. Tell him to get a quote, from an approved repair facility, and you will go and pay the repair facility yourself (also be sure to talk to the mechanic at the repair shop to see what kind of damage ...

Re: From Montreal, charged doing 112 in 80, court is 800km a

The particular electronic method you mentioned is not available in your case. The courts in Ontario (well, except maybe those responsible for the Hudson Bay coastline) require someone to go there in person.

Hiring a paralegal would cost more than the ticket, in and of itself. However, if you simply pay the ticket, you then have the insurance rate ...

Re: be asked for compensation

Compensation? Well, he'll have to get you a quote for the damage done to his vehicle from an approved repair shop. White marks on the tires only don't really warrant much of a claim, unless he needed to replace the tires. See what he says first. You have up to 7 days from the day of the incident to file a claim. Technically, though, there was no ...

See what Xcopper says and go from there. I'm not inclined to say "don't hire a paralegal," but gather some info and see what you think is best.

Re: what is the lesser charge??

Agree with admin. Careless driving is definitely something worth getting a paralegal for.

You could also get Left Turn - Not in Safety or Start from Stopped Position - Not in Safety as an alternative to Careless Driving.
