Re: Suspended License: Over 13 Years, how do I fix my mess?

In some cases, as hwybear says, you can make some sort of payment arrangements - instalments, etc. Once your outstanding fines are paid, you should be able to get your licence re-instated - if you have outstanding fines. I doubt if they've wiped the fines out, but do some checking and see how it goes. I don't know how much interest would have been ...

Basically if you have already started the turning movement, keep going. Otherwise, if it has a circular green but the arrow has gone amber, you may enter the intersection but you must yield to oncoming traffic before turning.

Well talk to the Prosecutor and explain what circumstances you are in, and that you will plead guilty in exchange for a joint submission for a lesser fine. Worth a try vs. handing over $325, given your situation.

Seems to be that way.

Although, my insurance company considers 45 over or more to be "major." Not really tied to the HTA, but probably their risk assessment matrix.

Prejudice is one thing. But you could demonstrate that your right to a speedy trial was violated.

Fight the ticket. If it's your first one, you should be able to plea-bargain it down to a 3-point offence (or 0 points, if you're really lucky).

If you were on the line or behind it (or maybe even slightly over it but not much), that would've tripped the red light camera if you made the turn after the light turned red.

Re: Need some advice on Court proceedings -very confused

Simon Borys feel free to chime in here...

Basically when it goes to appeal, the Prosecutor's office will submit their factum, argue their case with points of law, etc., and then you get to present your case. I'll look up some case law but I think that, if your appeal is handled correctly, the Prosecutor will lose again. It's a bit like the Netflix ...

You might be able to get the fine reduced (but probably not the speed) if you explain your circumstances. However, I would get a consultation with a paralegal or traffic lawyer, as Stanton suggests. If it were me, and the officer just saved me from the whole dog-and-pony show that stunt driving brings with it, I'd probably have just paid it and ...

Re: Need some advice on Court proceedings -very confused

In my view, the Justice of the Peace (and you) were correct. I would say the odds of that decision being upheld on appeal are good, but I would STRONGLY recommend that you seek a paralegal or lawyer to handle the appeal. The Prosecutor just wants another "administrative ace," if you will, that can be used. You were unrepresented the first time, so ...

No.

It will drop off your driving abstract after 3 years. However, MTO and the police have access to your full driving history, where it will stay permanently (your insurance company won't be able to see it after 3 years though).

The Prosecutor could still reduce the fine/charge if the city staff do not cancel the ticket.

People write down licence plates all the time. At the risk of sounding flippant, unless they actually were able to identify you or they phoned it in as it was happening (offence in progress), this is probably the response they got:

"Uh huh... uh huh... Okay, thanks for calling." *Click.*

You may get called by police, but that is not likely in ...

Not that this applies to the HTA, but the federal Interpretation Act says that "12th month after the date of the inspection" would mean the sticker is expired on the 31st of August. (Again, probably not applicable here... but time/validity is something I have to deal with from time to time, but my line of work falls under federal regs.)

There is no "one size fits all" answer here, really. I'd keep to the right unless the situation I'm observing and/or my judgement dictates otherwise. Seems to work. I guess the only one that would really be appropriate for everything is "don't make any sudden moves." If you're going ...

Mostly insurance. For a licence, it is four demerit points - significant but not severe.

Some insurance companies consider 50 over to be "major", some say 45 over, some say 30 over. Depends on the company. They all use different risk assessment tools to set their rates. Some of them will cancel a policy for a conviction for 49 over, but to my ...

Re: Out-of-province: can I ask someone else to represent me?

It is possible to request disclosure. Basically all you'd ask for in this case are the officer's notes (typed/explained if not legible), and video/photographic evidence if any exists. That's about it. They'll probably offer a plea-bargain to a reduced charge if your record is relatively clean.

For documentation - just write out a letter saying ...

Request an adjournment on the day of trial if the typed notes do not come through. Just explain that you cannot make full answer and defence without understanding the notes, and for that reason, it has to be legible, or the officer has to go through it with you. If the witnesses do not show up, they should withdraw the charge.

The rates will probably go up in that case, unfortunately. It sucks, given the move by the other motorist, however that's what the rules are. (I don't make the rules, I just shake my head at some of them.)
