I'm going to agree with the OP. The street on the immediate right (Queenston) is a one-way and they seem to "branch" at the same point... so I'd say a right turn on red to Niagara Street is ok. Of course... the Niagara Regional Police probably have their own view.

I believe they simply entitle you to park in designated accessible parking spots.

Were there other vehicles around you when you made that turn? If there are no vehicles that would've been "affected" by your turn, you don't have to signal.

The officer didn't violate your rights by not explaining why he stopped you. It's not the same ballpark as slapping cuffs on someone and tossing him in to the Crowbar ...

Unfortunately, I have to agree with Stanton and viper1. There's no way to un-do the suspension. If you get four demerit points and you are a G2 driver, they automatically suspend your licence for 30 days. If the officer thinks that's a U-turn, he'll find out that pretty much no one else believes that when it goes to trial... If the Prosecutor doesn't withdraw it first.

If they offer you a "First Attendance" meeting, you can go to that. (It's early resolution to meet with the Prosecutor and work out a deal.) Alternatively, you can wait until the day of trial.

If you want the easiest way to get out of this, unfortunately it's to pay the fines and reinstatement fee.

Really your best option is to go to the courthouse and choose the trial option. (Also file a Notice of Intent to Appear - you can print one off on-line and bring it, or they'll have one at the courthouse).

As far as the officer tailgating you, unfortunately that is not a defence to speeding. Although you may have done it for valid safety reasons ...

i also want to know if i should bring up traffic school, to ensure my insurance doesnt go up.. again this is my first ever ticket my record has been cleaned before this. im also the secondary driver on my parents vehicle, any advice would be greatly appreciated

I agree with Stanton. The Fault Determination Rules are actually quite clear on this matter and you are 0% at fault for the crash. You want to review sections 16 and 17 of the Fault Determination Rules.

I thought you can drive on the highway with G2 without any problem. Am I missing something in here, as I have been doing that for the past 6 months.

You are right. There is no restriction on driving on any highway in Ontario if you have a G2. It's if you have a G1 that you can't drive on a 400-Series Highway or roads like the Don Valley Parkway ...

Demerit points are administrative actions taken by the MTO. They only go on your record if you are convicted of, or plead guilty to, an offence that has demerit points. Agree with Stanton - shop around. Every insurance company is different. Some that promise big $aving$ really only work if you meet very specific, narrow criteria. I don't agree with what you were told. If you went to trial knowing that you had improper or incomplete disclosure, the Prosecutor would probably argue that's your problem, and that you should have taken care of it before trial.

My question: How long has it been since the date of the offence?

If the vehicle is not registered and you don't have insurance... you could get nailed for driving an unregistered/unplated vehicle AND for driving without insurance.

The Compulsory Automobile Insurance Act says "any owner or lessee" must have insurance for any vehicle they own/lease (section 2). I think that means that the vehicle requires it ...
