I did in fact stop, it wasn't a rolling stop, he indicated that I didnt stop for 3-5 seconds ...

As Simon says... the HTA only says you have to stop. There is no time period specified. The only requirement is that your forward motion must cease, even for a split second. I'd file for disclosure and see what his notes say. If they say something ...

Best way to start is to is make sure you're properly dressed (shirt & tie). Appearances really do make a big difference, and they will take you a lot more seriously. Sounds like stupid advice, but it's true. More than half of the people who show up for court are wearing nothing more professional than jeans and a sweatshirt or t-shirt. I've seen ...

Bring those rulings, your licence, and any proof that you might have that you were carrying a fare with you at the time.

I'm sure you know this, but the exemption allowing cabbies to drive without a seatbelt is because of robberies. Thieves would grab the seat belt to pin the cabbie in the seat while threatening them with a weapon. Sheesh... even ...

I'm not too optimistic that the delay could be attributed to the Prosecutor (court's supposed to send the notice), but plead your case with the JP and see what they do.

A legal dictionary is not Ontario law. To show the section Decatur mentioned...

The Highway Traffic Act states:

"driver" means a person who drives a vehicle on a highway;
Nothing about commerce or anything like that.

It's unlikely the disclosure would be ready by that time. You should be able to tell the Justice of the Peace that you never received a notice of trial, but in the process of following up, you found out about it - hence the late disclosure request. Then they'll likely adjourn so you can get the information you need.

Agreed, it would make sense for the officer to say why he stopped the OP. That goes without saying. I really haven't heard of too many cases (except the ones I mentioned and this one) where the officer didn't mention the reason for the stop... even if the delivery was poor.

It comes down to basic courtesy, if all cops pulled people over and ...

You do not need a lawyer. If you are intimidated by the process, you could hire a paralegal. When you get your trial date, file a disclosure request (see "Courts and Procedure" on this website) and get the evidence against you. The only thing you should ask for are the officer's notes, and any video/photographic evidence if the Prosecutor intends ...

You can have a licence that's both expired and suspended at the same time. They're different "layers" of not allowing you to drive.
