Nope.
It might help you at trial but not as far as the "fatal error procedure" goes.

Re: Notice of fine due sent and license suspended 3 days lat
Best thing to do (and I'm not clear from your post), is pay the ticket and reinstatement fee first. At least that deals with problem #1. You can file to get it re-opened after that. At least, at that point, you are not suspended. You might want to consider talking to a paralegal or traffic lawyer about what your options are.

Re: Driving protocol
In most places, the people who dive off a freeway at the last second are the aggressive ones. In the GTA, 75% of the people who cut across three lanes and the bullnose at the last second were going 10-20 km/h under the limit in the left, or second-to-left lane. Not surprisingly, it seems to happen much more frequently here than other cities...

The Aeronautics Act states that a commercial air service is any use of an aircraft for "hire or reward". Hire or reward is further defined as any payment , consideration, gratuity or benefit directly or indirectly charged, demanded , received or collected by any person for the use of an aircraft. (Aeronautics Act 3.(1)) A search of the aircraft ...

First of all, I agree with you in that legal representation is ABSOLUTELY NECESSARY in a situation like this. The officer's suggestion to "just show up in court and tell your side of the story, you don't need a lawyer" is something that I absolutely do NOT agree with. The offences your friend is charged with are very serious and, in totality, will ...

Not to my knowledge. You'd have to either have some serious allergy to nicotine, or be suffering from nicotine poisoning (or something like that) to become incapacitated/impaired by tobacco smoke.

Re: DRIVING UNDER SUSPENSION-1st offence
I agree with Stanton here, however I would recommend talking to a paralegal or traffic lawyer ASAP. Most of them offer free consultations. The ticket for failing to produce his licence will probably stick, but that's not that serious. The "drive suspended," particularly over a $150 reinstatement fee, will probably end up being Drive with No Licence ...

If the situation was as you described, he wasn't evil, but maybe not thinking.
Most school bus drivers flash their yellow lights BEFORE they stop, and then they turn the stop lights on as they come to a stop. This gives people enough time to react and stop appropriately. While there is a reasonable argument that you should've anticipated his ...

Best way to start is to is make sure you're properly dressed (shirt & tie). Appearances really do make a big difference, and they will take you a lot more seriously. Sounds like stupid advice, but it's true. More than half of the people who show up for court are wearing nothing more professional than jeans and a sweatshirt or t-shirt. I've seen ...

Bring those rulings, your licence, and any proof that you might have that you were carrying a fare with you at the time.
I'm sure you know this, but the exemption allowing cabbies to drive without a seatbelt is because of robberies. Thieves would grab the seat belt to pin the cabbie in the seat while threatening them with a weapon. Sheesh... even ...

I'm not too optimistic that the delay could be attributed to the Prosecutor (court's supposed to send the notice), but plead your case with the JP and see what they do.

It's unlikely the disclosure would be ready by that time. You should be able to tell the Justice of the Peace that you never received a notice of trial, but in the process of following up, you found out about it - hence the late disclosure request. Then they'll likely adjourn so you can get the information you need.

Agreed, it would make sense for the officer to say why he stopped the OP. That goes without saying. I really haven't heard of too many cases (except the ones I mentioned and this one) where the officer didn't mention the reason for the stop... even if the delivery was poor.

You do not need a lawyer. If you are intimidated by the process, you could hire a paralegal. When you get your trial date, file a disclosure request (see "Courts and Procedure" on this website) and get the evidence against you. The only thing you should ask for are the officer's notes, and any video/photographic evidence if the Prosecutor intends ...

You can have a licence that's both expired and suspended at the same time. They're different "layers" of not allowing you to drive.
