I am getting disclosure but not entirely sure what to look for.
In your case, it looks like full disclosure would be a copy of the officer's notes and the lidar manual. For the manual, they will need to provide you with the parts of the manual that deal with the testing and use of the device. This is so that you can determine, from the officer's ...

Re: What can I expect on my trial date?
How did the crash happen? Did you go off the road or did you hit a parked car... ?
If you went off the road and hit something, you may be able to plead to a charge of Leave Roadway - Not In Safety.
Other than that... Traffic Law made a very important point above. What you said in the statement is very important. If it does go to trial, you were ...

Re: "Bilingual Defence" - Where it can be used
Some of the discussions that happened since this was posted indicated that bilingual defence would not work. The story is, the City of Toronto appealed R. v. Myers, and then Myers pled guilty instead of going through another trial... go figure that one. We also found that only a Superior Court Justice may make a declaratory order, and the JP and ...

Couple of things. If her brother's car did not have insurance, her brother can be charged under the Compulsory Automobile Insurance Act - not her, unless she is listed as an "excluded driver" under insurance. (However, you said the vehicle was not insured... so, in an odd twist of things, she wouldn't be charged anyway. ) The owner cannot ...

Re: 401 in Toronto with light traffic
Well, they were several months ago, I just covered them up with spray paint as a temporary fix. Damage = Front bumper + right quarter panel (two separate incidents). Plus, scratch to hood - was entering an underground parking garage when I lived in Windsor, ramp was angled, roads were a bit slushy but okay, entered the ramp which was a skating rink ...

Re: 8 Month Pregnant Wife Gets Big Ticket on 24
One of the questions for court would be "where on hwy 24 did you get the reading of 96?" (As Reflections indicated.) Then you'd have to submit photographs/proof of the fact that the speed limit wasn't 50 at the point where she was clocked at 96... it's a minor point, though. As for photographs, buy one of those $6 (or whatever) disposable cameras ...

Re: Speeding 146 KM/HR IN 100 KM/H Zone
One other thing to add... if they go to trial on another date and the officer is not there again, do not allow them to adjourn the trial.
Stand up and say something like: "Your Worship, with the deepest of respect I cannot agree. This is the second time I have come to Cambridge to present myself for trial, and again, I have been ready to proceed ...

1) does anyone have case law or information on lidar errors with regards to determining the speed of a motorcycle?

Re: Using court to postpone payment/insurance hike !!!
Truthfully, it's unlikely that they'd change it, particularly in places like Mississauga. It can happen within 6 months of the offence if the Prosecutor has a mean streak.
To prolong the process, do exactly what you proposed: Set a trial date and then plead guilty before the trial starts. If you receive a notice that they intend to change the ...

Re: 401 in Toronto with light traffic
Any good tailgaters?
The BMW that edged by on the right was sitting on our tail until my wife moved to the centre lane to let him by. He wouldn't move left, so she did.
When did you get the Accent? I thought you had a Civic.
The Accent's a rental. You thought correctly, I do have a Civic... but my wife's Saturn was in the repair shop for ...
