Re: We're not unfairly complaining about congestion

since I don't live in the GTA area...phew...(I have a 6min/1.7km drive to work) what is the cause of all this?

All four of what you mentioned contribute to it. Mainly, it is volume. Top reasons for that:

- GTA is the 2nd most densely populated metro area in North America
- Lack of public transit that can be used across municipal boundaries (e.g ...

Re: Ticketed for right turn at yellow light [resolved]

What do you think, Radar? Would I be at an advantage if I go with FyreStorm's idea?

Pleading to disobey lane light would give you no demerit points, smaller fine, and probably a minor (but not big) insurance increase for 3 years - depending on your provider. Some may forgive the one ticket. Better than a conviction for Red Light - Fail to Stop ...

We're not unfairly complaining about congestion

Toronto has longer commute times than Los Angeles, New York, London, Sydney, Chicago, Berlin and Paris. 80 minutes average commute.

Cross examination: They might try to hammer you into a "the officer is lying" trap. Don't fall for it. If they flat-out ask you "so you are saying Constable X is lying?" then pull the usual trick that's used in interviews (why are you better than the other candidate): "I can't speak for the officer. I only know my version of events and what I ...

They can enter into evidence anything that they want, but the stuff that they need to give to you is enough to "make a full answer and defence" to the charge. So yes and no.

They could enter minor, irrelevant stuff without disclosing it, but any relevant, important stuff must be disclosed to you.

Re: Following too close due to deer in lane-court May 4 2010

There was no willful disregard for others in such driving, so a Careless would never stick.

I disagree. The "disregard" does not have to be willful. It only has to be lack of due care and attention, or put another way, falling below the standard expected of a reasonable and prudent (but not perfect) driver. However, you're right - momentary ...

Re: Rec'd Disclosure - Do I have a Case? Looking for advice.

Crown did not disclose the correct manual = adjournment + delay charged to the Crown... If you act on it. Did you send another note asking them for the correct manual? Also, how long has it been since you were ticketed?

If the officer does not have a clear recollection of the events, then you should be able to win. Plea-bargaining is also an ...

Re: What if I don't show up for court... baby due within days?

Some places have "walk-in First Attendance" where you can walk in and meet with a Prosecutor to try to resolve the issue before the court date... as it does in your case. Do NOT avoid the court date. Re-opening a case is like pulling teeth. Get it moved, or resolve it early, but do something about it!

If it really comes down to it, go in early ...

Re: Speeding 115km/hr on highway 400

Like I said, if you get stopped going 30 over ($240 and 4 points) and the officer gives you a 15 over for $52.50 and no points, only a (no offence intended) knucklehead would fight that in court unless you can prove it was someone else...

Or the ticket bears a fatal error, or the evidence disclosed shows the officer made a big mistake ...

Re: Polive testifying about visually observing high rate of spd

I use some fairly sophisticated radar equipment and I've never seen it fail or produce erroneous readings. I've seen plenty of people misread it or not use the controls properly, but the radar doesn't lie.

Commercial courts ie traffic courts are quasi courts apparently. This would mean that they are either quasi civil or quasi criminal as there ...

If she pleads guilty with an explanation, the demerit points and conviction go on her record as though she'd just paid it. The fine may be reduced, but unless there are extenuating circumstances, that's rare.

If you fight it, you then have several options, including plea-bargaining to a lesser offence (e.g. speeding 15 km/h over), going to court ...

Re: What You Should Do if Pulled Over By a Police Officer

Also leaving a glove box open for them to look in equates to illegal search.

That is the option of the motorist. I leave the glove box open before the officer approaches because the officer can see that I am not carrying any weapons. I also keep my hands in plain view, roll the windows down and shut the engine off. There is no law or requirement ...
