Re: OPP dropped radar tests, now it is in the news
To anyone familiar with the design and operation of electronic measuring equipment the situation involving radar gun testing in Ontario has always been a joke. Any device like this requires an external test against a standard to verify accuracy. A simple internal device test can verify the electronics are functioning but without an external test ...

Re: Speedometer calibration and case laws
In one of many seminars I attended over the years, the gentleman who was presenting said "in God we trust, everyone else must provide evidence"
Sadly, the courts take officer's testimony as "evidence"
In the world of metrology, no matter how dismal or serious, from a minor industrial calibration to pharmaceutical calibrations, there must exist ...

Re: Radar Manual- No tuning forks and No tracking history
I was just told about the CBC report by a co-worker of mine.
I find it funny how two people confirmed what I had said in my earlier post regarding the testing procedure being modified at the request of the "customer" (Ontario)
Note the former OPP officer stating he made the request for this change and the ex employee of Decatur stating they made ...

Re: Summons To Witness
One thing you can not be sure of is how the insurance companies will look at this.
If he was charged, he was at fault according to police, thus your insurance rate is not affected and his is.
However, if you do not show up and the charges are dropped, the insurance company may decide that the fault was 50/50 and both drivers are faced with a rate ...

The filing date of a ticket
OK, so as I understand it, the officer has seven days to file the ticket, if it is not done so within that period, the ticket is kind of nulled.
I see this in a couple of places mentioned as "fatal error" and recall from my conversation I had with a city staff over ten or fifteen years ago, I was trying to pay a ticket but it would not come up on ...

Re: Radar and GPS
The new A.L.R.P. (Automatic Licence Plate Reader) cars do have the lat and long attached. The system automatically reads your plate as you drive by and runs it through the system. If there are any problems such as expired val tag or the registered owner is suspended, it will squak and you will get pulled over. I would think if you, say, had a ...

Thank you for clarifying.Stanton wrote:Yes, when defendants have gone to trial.
Followup question: have you ever seen a defendant win the case with a video evidence being presented?

Re: Dash cam video
It's very infrequent since most defendants don't bother forcing a trial if they feel there's relatively definitive evidence of the offence. The very few times I've seen defendants force a trial when there's video evidence involved people who felt there was a justification for their actions.
OK, thank you both for your comments.
But I am not ...

Dash cam video
Yesterday I attended a traffic court in York region.
The process went as you would expect, the prosecutor called each defendant one by one and offered a plea deal and nearly all of them accepted the deal and pleaded guilty.
Near the end of the day the prosecutor asked for a recess to setup some videos and during this time they played dash cam ...

Re: REQUESTING DISCLOSURE OF RADAR/LIDAR MANUAL
I seem to recall reading transcript of a case where the prosecution argues exactly that, why the can not make a full copy available to everyone asking for it.
Decatur is right, but you can word your request as you have, then you can use it in court to try and justify why you need the manual in its entirety. What differentiates a good attorney from ...

Re: taking the stand as a expert witness
When you put yourself on the stand you open the door to all sorts of questions. So to assume you will be asked one set of questions and not another would be somewhat unrealistic.
The question is, what type of an expert do you consider yourself to be? And assuming the JP agrees with your opinion of you being an expert, can you navigate through the ...

Re: 35-40 over but not issued a ticket
Not all officers are traffic enforcement, so depending on how he got your speed, it could also be the case that he took all your info to pass it along to another officer to issue a ticket. At times they don't even have a ticket book in their cruiser.
If that is the case, then both officers will have to show up at court to testify.
This is a very ...

Re: Do officers know about dismissed tickets?
@Stanton,
Just want to make sure I got this right...
Are you saying that even though the person was not charged for an offence (went to court and charge was dismissed) there is a history on his/her driving record that shows as such?
I understand there is a court record, but that is not what the officer has access to on the side of the road.

He blew a warn and got a 3 day suspension. Because of his age and licence class he got a ticket for having any alcohol in his system at all.
