That's one definition...
The Highway Traffic Act of Ontario defines driver as - "driver" means a person who drives a vehicle on a highway.
So that's the definition.
Each statute may set out it's own definitions, so don't get too hung up over what another book may say, when it comes to the HTA, it's the HTA's definition that matters.

Re: Advice yellow plate cover ticket
Here's a few questions:
How can you tell which people warnings work with and which it won't?
Why do police have to warn people when they have a duty to know the law?
Statically warnings don't fix the problem. Sure most people will take the cover off, but cause we can't stop everyone, a large number will not. I've personally had several drivers ...

Re: Advice yellow plate cover ticket
Well I suppose it could be argued you should have got a warning, but then everyone else should get one too right...where do you draw the line on warnings?
I suppose we could all go around everyday and warn everyone all the time, but then really people would not fear the consequences and just say I'll just do it til I get a warning, then wait to ...

Re: How to submit photographic evidence at trial?
Likely shouldn't be objected to...unless there has been some material change...
It's stuff like window tints that can be reduced then photographed and claimed to be as they were.
I stopped a guy once whose Escalade's windows were so dark he coulda been welding in there...he show up in court with pics of the truck with NO window tint and said I ...

Re: When officers break the law...
By the way, I really hope you are more of an aberration than a typical constable considering your lack of respect for the proper legal process. While our Charter is largely useless as long as NWC's invoked, it should still give us some guarantees regarding fair treatment by law enforcement officers and the courts. Those guarantees were created to ...

Re: Advice yellow plate cover ticket
Weird, I've charged maybe 75 times under that section and always gotten a conviction...people bring their 407 bills, but the 407 is known to make lots of mistakes...and clearly if you've changed the apparent colour of the plate it's confusing the identity. Plus a tint of any kind makes it harder to read as it lowers contrast. I had one JP state ...

Re: Suuuuure, there are no quotas
Sorry to get back on topic...but 28 tickets a day? That doesn't sounds possible...assuming 30 minutes to find and ticket each offender...well those are 14 hour shift plus lineups, lunch, bathroom breaks, court, training...28 a month / rotation sounds what they meant and seeing as officer on 12 hour shifts work 14 of 28 days it makes a lot more ...

When officers break the law...
I wrote this article in response to another post regarding an on-duty police fficer involved in an MVC a a result of what appears to be some boneheadedness on his behalf...but it's a good talking point...so I've reposted it here to get other perspectives...

Re: Lead-footed OPP constable remains on duty
This is unfortunate. But I'll cast my perspective on this...
At most collisions these days civilians get to go to the Collision Reporting Center, no charges are laid and life moves forward.
Officers like this fellow, have a police investigation, get charged, also get charged under the Police Service Act for Discreditable Conduct and generally ...

Re: Threatened with racing charges
255 in a 100 km/h zone? Yikes that's just plain dangerous driving (Criminal Code)...I can't see any reasonable excuse to go 155 in a 100...even the police who get special training are instructed that at about 40km/h over the speed of traffic your training won't help you...
If you are doing 155/100 you deserve the stunting ticket. That's ridiculous ...
