Hi, I'm curious what the courts detemermine "return immediatley" to the scene of an accident is? Is it 5 minutes, an hour, 2 days? Surely this will depend on the JP but I'm wondering if there is any case law/personal experience regarding the subject. Thanks! Cruz.

The only case I could find that was related was R. v Robson, but it doesn't really answer your question. Basically the guy intentionally hit a cyclist and drove off, returning 45 minutes later from a doctor's appointment. http://www.canlii.org/en/on/onsc/doc/20 ... 18728.html Leaving the scene to seek help and return immediately (as SOON as the call is placed or help is found, then no delay in returning) is permissible according to a former police officer. Beyond that...

I would agreewith "RI". If one does not have a cellphone, one would be given opportunity to go to the nearest payphone, call for help and return OR advise the services responding where the hell you are!

I received this ticket after being involved in an accident. The accident happened when a red sunfire came into my lane the left lane from the right lane without looking. His car hit mine and pushed me across the yellow line into oncoming traffic where I had a head on collision. The red sunfire also…
Well I have a few questions about how I should proceed with this charge.
I am acting as my wife's agent, and although I'm not a lawyer I and familiar with court procedures and have gone to a few trials (all successfull outcomes!)...

So just heard on the news that a new regulation is being implemented, soon police officers stopping people will need to advise them they do not have to talk to them. Odd if you ask me, because it makes the entire process moot since right there that individual can turn around and say "OK, then I'm…
I got this ticket PROCEED CONTRARY TO SIGN AT INTERSECTION Sec 144 (9), there was a street car in front of me and i couldn't see the sign which said no left turn btwn 7:00am and 6:00pm, there was no vehicle coming from the opposite side so I signaled and turned left.
I recently got this ticket - 'Fail to properly Wear Seatbelt'. Any advise would be appreciated.
So I stopped at stop sign to make right turn on a busy street and I saw a cop driving by at least 50 - 60 km/h. When I made a turn finally, the cop was parked about 100 meters away from this…
We (I am acting as someone's agent) are going to court in near future. It is not a trial as the prosecutor said he would change it to be spoken to, and that we'd have the option to plead guilty, request another adjournment, or to agree to set a trial date from this point.
Hello, this is my first post on this board... my 17yr old son was stopped this week and charged with driving with invalid/stolen plates (they were given to him by a friend as he had no money to get his own) and driving with no insurance (yikes). I have to say he does not live with me else i would…
I was pulled over recently. I did stop just not for a full 3 seconds. The officer appeared nice and reassured me to just fight it in court. I am not sure whether this implied he would not show up but my chances look good. What should I do? Not Guilty wants to charge almost $300 to fight it in trial…
