Re: Failing to move, where possible for emergency vehicle
New this spring, tow trucks are included in move over law....
But who is going to protect us from Tow Truck drivers?
MacCharles said besides this "dubious" behaviour, tow truck drivers have an extraordinarily high collision rate, 20 per cent compared to 1 per cent for other commercial vehicles. http://www.thestar.com/news/queenspark/2014/04 ...

A quick Google of that name links to all sorts of scam and fraud allegations. For any posters seriously considering his services I'd point out that reputable paralegals have no need to spam this board for business.

Hi AndruLuka.
If you haven't noticed, this board is in regards to the Ontario Highway Traffic Act, a piece of legislation that exists in Ontario, Canada. 'County law', 'local rule' or 'state law' (as you've mentioned in some of your other posts) are completely irrelevant to anything discussed on this forum.

So why does it say: "Towed vehicle(s) includes trailers, farm implements and wagons." in the HTA 32, 37, Reg. 340/94 quoted above?hwybear wrote:none of the farm exemptions apply when you have 4 axles or more
A wagon has two axles so with a pickup or tractor you are at 4 axles. When would you ever have less than 4 axles when pulling a wagon?

So if you're doing 151 km/hr, the time thru the zone is 11.92 sec but if you're doing 149 km/hr, the time thru the zone is 12.08 sec - difference of 0.16 sec. Given the distance between the officer in the plane and the subject vehicle it could be argued that the accuracy of the officer's reaction time resulted in too high of a speed recorded. I'm ...

The dealer loved the arrangement not just because they got him to lease a new car every 6 months but because they also had a regular supply of off lease cars that were "previously driven by Steve Jobs" which increased the value.

If it is not marked as you indicate, there is 2 speed limits of:

Under the law, is it strictly whether the road is in a "town" or "township" that determines the default speed limit? There are a few townships that have become towns even though they have some ...

As for the temperature range, that's to prevent damage to the instrument (mainly the battery), it should have no effect on accuracy. And if the true outdoor temperature was within range, I don't see what benefit there would be to introducing weather evidence.

I don't know what "fatal error rules" you're referring to, but, as I said, anything that prejudices your ability to make full answer and defence is usually considered a fatal error, which makes sense if you think about it. In my experience, fatal errors would be things like no date, wrong or missing act or section number, no defendant listed, no ...

Speed limits are to be the same on BOTH sides of the road, in normal<-------- driving conditions. Construction, special events etc. will change things. If you can find a location where the speed sign are offset by a considerable margin, 100's of meters not 10 meters, it is a valid arguement in court that you were not speeding.

I'd file it now. The delay is apparent now, so you may as well get the paperwork in. That said, as long as you have it filed at least 20 calendar days before the next trial, you'll be okay.
