Re: 0 demerit points

That is true, your insurance rates will be affected with a conviction either way, but don't forget, you will be going up to 3 points as well if convicted for the 20 over...

Re: Fatal Error on Crown Brief Synopsis?

Part 1's can certainly have a Crown brief...There is quite often just a small synopsis done up so the prosecutor has an idea of what went on, along with copy of the driver record and printout of the vehicle info...it is just local policy as to if one is done up or not...

Re: Failure to provide insurance but it was in the car

jsherk says this is a bs charge, but is it really?
Why were you stopped in the first place? Could the officer have written a different ticket, one with a higher fine and points? Perhaps the cop was trying to be nice by laying a lower-fined charge, and a charge with no points...

Re: can you still get a ticket ?

If he was going to get a ticket, they would have pulled him over right then. 120 on the 400 is not going to make them sit up and take notice unless the weather conditions are bad...They are looking for the high milers...

It does not matter where he wrote the ticket...it only matters where the offence occurred...Activating the lights or not has no bearing on any stop

The usual practice argument likely won't work as the officer states he recalls doing the test, just didn't note it...if he actually says something to the effect that it is his usual practice to do it, then that line of defence may work...The "T" is simply the mode the radar was in: The Towards mode-the radar will only pick up vehicles that are ...

Re: Carrying two insurance cards Ontario

There is no way in the world you would get a fine for $10,000 for having two insurance cards in your possession if one of those cards was from a valid contract...If you look at the intent of the legislation, it is ensure all motor vehicles are insured should there be some form of accident. That section is soley for those people who abuse the system ...

It was a laser charge, not a radar charge, therefore there will be no proof of speedometer calibration/accuracy...and no clarification needed of whether the speed was determined by radar only...the speed was obtained by laser only...
Make and Model: was in his notes...Laser Atlanta, with the serial number...
