Re: Urgent - Illegal Stop & Arrest On Private Property
Maybe it's just me, but I am guessing you drove the car there...you admit your guilt when you were on the highway...So you were guilty then, but not on the private property, and you would have been guilty again when you were going to leave the private lot?...several different people have pointed out why the enforcement action was ok, even though it ...

Re: Urgent - Illegal Stop & Arrest On Private Property
I agree...at no time did the OP state he did have the correct validation on the plate and that everything else was in order...given those types of charges there likely wasn't any insurance on the car either...and as the others have stated, it is an anywhere offence, it does not have to be on a highway...if there were no cops around the OP would ...

Re: Question about Red Light Camera on Highway 7 and Bathurs
Has anyone else ever seen a traffic light, in Ontario, go directly to red, from green, without and amber light in between? I have been driving for a long time now, and have traveled throughout this very large province and I have never seen that...I haven't even heard of that happening in Ontario...a malfunctioning light perhaps?

Re: What if cop shows up but witnesses don't
The email may be worth something actually...if it was a witness statement, and is given as disclosure, that is its value...the witness will still have to attend to give evidence and be available for cross examination. There may be enough evidence if only one witness shows up. The prosecutor does not have to call every witness listed, only those ...

If you do plead not guilty, and your daughter was traveling at a rate of speed greater than was on the ticket, the prosecutor will ask to amend the ticket back up to the origional speed...a bit of dust on either the lens or in the air will only affect the effective range of the laser, not the accuracy.

Re: ATV 20km/h speed limit ticket, implications?
The ticket comes from Regulation 316-06 of the Highway Traffic Act. Section 22 reads:
Maximum speed
22. The off-road vehicle shall not be driven at a rate of speed greater than,
(a) 20 kilometres per hour, if the speed limit established under the Act for that part of the highway is not greater than 50 kilometres per hour; or

Yes, the records will still be there, no doubt at all...Ontario did not issue warrants for unpaid fines for people who did not pay their fines for traffic tickets, they only suspended their licences. There was a time they issued warrants for unpaid fines for convictions under other statutes such as the Liquor Licence Act, never for Highway Traffic ...

Yes, you only need 1 working tail light or brake light when out driving. The only time you need 2 is for the safety. There are specific charges for lights being out, section 84, the unsafe vehicle section, would only be used if you had several violations such as a couple of lights out, no emergency brake, worn tires - it's more of a catch-all ...

A conviction for that offence is only 3 points, unless you have other points on your licence you shouldn't get the suspension. A G1 or G2 driver gets the 30 day suspension when they get 4 points in total.

There are many factors the prosecutors consider before agreeing to lower the rate of speed down...an increase in the insurance rates is not one of them...they are well aware of the fact that the insurance premium will increase, exponentially. That is correct: Highway Traffic Act: Regulation 628, Section 6(2) "Evidence of validation for a permit SHALL be affixed to a number plate for the vehicle in accordance with this Regulation, and the portion of the evidence of validation not intended for the number plate MAY be affixed in the appropriate space provided on the permit for the vehicle".

One big problem with the clear covers is some people put the validation sticker on the plate cover, not physically on the plate itself, as it should be...you certainly can get a ticket for that...If the plate cover is in good shape you should have no problems with it.
