tickets (P.O.N.) can be issued anywhere, he can follow you to your house (private property) and hand you the ticket/summons upto six-months from Tuesday for contravening s78.1
but the actual offense of holding the hand-held device, has to be on a public road not in a McDonalds Drive Thru

if there is no reasonable prospect for conviction they will withdraw the charge

from what you have described it appears aslong as the police report and all the witness statements say that vehicles A & B were fully stopped and not in motion then vehicle B would not be at fault
just give your accident report # to your insurance company and let them deal with it

i only wish there were more initiatives on proper lane change enforcement, especially at transfers I would rather see the move/merge over 2km before and see them "fidgetting waiting" than the 200m and less lane cutters from left to right across 3 lanes and just going across the "bullnose" area of the ramp! your best course of action is NOT to attend trial, in your absence the JP SHOULD see the missing section number and quash it
however if the JP doesn't see the missing section number, you'll have excellent grounds to appeal and re-open the case ...

A family friend received a reduced speeding ticket for +15 on the QEW and on the Offense Notice my friend's given name was written as an initial; his family name however was written in full
