Re: officer death in the family

the new delay is without a doubt attributed to the crown; from the alleged offense to the new trial, is it longer than 11 months? if it is, you have an opportunity to use an 11b

Re: Should I fight this HTA 182(2) ticket.

i would highly suggest that you retake these pictures with a proper time-stamp, they might otherwise be inadmissible in court; i would also suggest including a street-sign in the background, just so that it doesn't appear you took a picture of a random intersection with pylons and a 'No Left Turn' sign

i would contact the city and find out if ...

Re: Careless Driving Ticket Help!! court tomorrow.

all three are VERY serious charges

if you plea-bargain: S. 130 Careless Driving usually gets reduced to S. 141 (5) Left turn - fail to afford reasonable opportunity to avoid collision , this carries 3 demerit points and a fine of $110

it's possible the crown will drop the other two charges in exchange for the reduced plea-deal, maybe some members ...

Re: Could I fight a speeding ticket as a strict liability?

has anyone successfully used 'due diligence' against a s172 charge? i have an example of an epic fail attempt:

R. v. Anghel, 2010 ONCJ 652 (CanLII): http://canlii.ca/t/2fg2d

Mr. Anghel gave evidence that he believed he was travelling at a speed of perhaps 127 kilometres an hour. He based that belief on his speedometer reading and also his GPS ...

Re: Fail to properly wear seat belt - In Provincial Park

no seat-belt is a strict liability offense which means you have the opportunity to show due dilligence

do you still have the parking ticket or receipt you purchased? it may help in your defense, especially with the timing

Re: 96 km/h on 60 km/h zone

how exactly are electronic tickets are issued?

1) officer logs into a police software in his mobile cruiser computer
2) enters drivers license info?
3) checks to see if it's 10-60 (clear?)
4) punches the dl number in P.O.N. form, it autofills the info for the ticket?
5) ?

Re: Issuing Parking Tickets in Private Lot

Well i believe the MLEOs and Security Guards will know how to get the vehicles towed at owner's expense; from my experience as long as there is a provincial offense notice and the vehicle is cleared by police that it isn't stolen... tow companies familiar with city/police towing will begrudgingly take it

Abrams/Lyons Tow Guys advised they get $50 ...

Re: Issuing Parking Tickets in Private Lot

City of Kitchener may have an MLEO program for Security Guards; so if parking is of concern, you could talk to the property manager and allot additional money toward having a Security Guards there during business hours issuing Provincial Offense Notices for 'Park on Private Property'

You yourself can get a license to become a Security Guard, and ...

Re: need help for disable parking ticket

a lot of information here on how to prepare an 11b application; if the 11b fails, be prepared to go to trial; from my experience i was advised by the prosecutor that if i proceeded with my 11b motion that plea-bargains would be 'out the door'

the MLEOs i'v dealt with check very thoroughly; we had a situation where there was a vehicle occupying a ...

Why not submit another disclosure, requesting for instructions on how to open the video file? This may get you another adjournment and allow you to review the video.

Just make sure for the new trial that you do the 11b application in a timely manner, because this is definitely a slam dunk for you

Re: 135km/h in a 90km/h zone on hwy 17

When you filed your tickets, did you select Option 2 or 3? Option 2 is the Early Resolution meeting and Option 3 is going to trial; it will be interesting to learn that certain jurisdictions are scheduling Early Resolution meetings for everyone

Disclosure Requests requires the date and location of your trial, so you will need to wait until you ...
