We all constantly pay taxes at the pumps, stores, property tax etc..... or utility charges of "delivery to you" charges etc....where we have absolutely no control over it and don't complain....
Yet we have complete control over our fate on the roads and all of a sudden when someone gets stopped it is a a tax grab. It is easy to control your own ...

Military Base - HTA applies, federal acts also apply
Provincial Parks - HTA and Provincial Parks Act apply

Re: Left turns and cyclists
yes, bicycles have to follow the same rules of the road.
Having been trained as a bicycle rider for work, you also should be utilizing the "lane block" technique. If in the left most lane, you would stay in the right tire track. In the right lane on a left turn, you stay in the left tire track (same as a MC rider would). This maintains your ...

I know there was no radar involved because when I drove past her she wasnt putting down any radar gun, she was putting her car in gear.
Simply put the radar unit down on the seat beside, then reached up to put the vehicle in gear. Would not keep the unit in your hand if you have already obtained a speed, identified the vehicle and now you want ...

yes, we have to share the road, we also have to remain in our own lane. Bicyles also have the right to the complete lane of traffic, often it is unsafe and not enough room for a car and a bike on the same lane anyway....so they have their spot on a lane in traffic....stay there

What do barriers mean?
Combined with the cyclist post today....here is another.
There is a road closure in town today on a major artery, but it is Sunday so to avoid week day traffic.
There are barriers across the road, road closed sign. About 200 metres down, you can see the bridge in the air (bridge over a river) which is being repaired. Obviously you can not go thru ...

We're lucky no changes were made to the Criminal Code.
Actually, there were changes made to the Criminal Code by the Conservative gov't in 2006. They specifically created:
- Dangerous Driving (Street Racing), section 249.4
- Causing bodily harm by criminal negligence (Street Racing), section 249.3

After all, how can i be clocked on radar at 144km/h in a car that is governed (speed limited) to 135km/h maximum.
- maybe the speedometer is not accurate
- maybe the tires size based on the speedometer are not as the computer thinks, thus the speed would be different

Re: Disobey stop sign-stop on wrong place AND permit request
. And the permit ticket can be cancelled if I show it in the police station with in 72hrs, which I did it. There is one thing I do not know. It is that the permit request says "on the highway", Is that include the local area?
FYI The ticket does NOT have to be voided if shown within 24/48/72hrs etc.
Highway = every road you can drive on.

By the sounds of it the section is 12(1)(d) which there is no set fine, therefore the officer does not have a fine to give at roadside, therefore a summons is issued.

main thing is the notes are provided to the defendant/counsel......now who cares how one writes.....if the notes can not be legitimently read, a typed identical version should be provided upon request.
i have given testimony without the use of my notes. some events just stick out in the mind.

Re: Officer Alters Official Notes
Every speeding trial (10+yrs), my notes are altered and I explain this to the JP. I have never been refused to use them. There just has to be a logical explanation for the alteration.
Anyway, if you think the officer did whatever to the notes, when the officer goes to qualify notes, this is when you can ask the JP about this situation.

What's missing is
1) Any hand written notes - Is it possible that there where no hand written notes and they where typed directly into the system when the ticket was issued (This is London).
2) A copy of both sides of the officer's copy of the ticket.

yes, changes to notes are permitted.jmarkus wrote: 1. Is the officer allowed to make several changes and add statements to his official notes months after he originally wrote the ticket?
reminder, notes are not the "end all, be all" of evidence. If one has that good a memory, some notes do not need to be made.

Unless you do what we do, you do not understand. Quickly, we are supposed to demonstrate proper driving at all times, following all rules of the road. Most often we have are in a great big billboard, we do one thing that violates any rule of the road and someone calls into complain. Now pending what it is, we can be spoken to, written up and spoken ...
