Re: Section 7 & 11B

I checked the disclosure they gave me and it was missing some of the items I requested. I again requested disclosure of the missing items twice without any answer.

All requested items don't need to be fulfilled, only what is considered enough to satisfy your disclosure request. Be prepared for anything because there's a chance your requests will ...

Re: Speed Trap - 79 in 50 zone

Good morning, I am a new member here. Talk about speed traps, I live in Ottawa. This morning on the River Parkway there was a flashing speeding sign (for lack of a better word)…. Are these signs equipped with cameras to give tickets?.... If so, there must have been tons of drivers who will get tickets. I guess they just started doing this today ...

Sorry, not excel 90. That wouldn't make any sense. I'm not sure what he wrote there.

Re: 80Km/h in posted 60KM/h - Radar reading 91 - Disclosure

I'd assume it's the officers abbreviation for "only vehicle inbound".

Either way, the officer writes "excel 90. activ.@ 91, locked @ 90. Sustained until pulled over. Driver said he didn't realize"

He didn't lose track of you. He got all his evidence while following you, which kills that argument.

Re: 80Km/h in posted 60KM/h - Radar reading 91 - Disclosure

The notes are missing time stamps / date and time

His notes don't need a date at the top. If you need a date and time, it's listed on your ticket.

Further, the police officer was travelling SB and I was travelling NB.
There were no street lights... the officer had to turn around on the two lane road. One for NB and One for SB traffic before ...

Re: Parking Ticket & Unjustly Towed from Private Property

b) what will happen if I don't pay the tow truck storage fee? Will it just keep running?

Anyone, whether a company or individual, has a responsibility to mitigate their damages. They can't let your car sit there for years and turn around and sue you for $1 million. They'll take action sooner or later.

c) is there some type of grace period ...

Re: 182(2) Disobey Sign - Have disclosure, need Help!

For what its worth, the parts of the officers notes that are understandable include some major errors. He noted that my truck is Gold (it is actually silver) and that the date was a Saturday (it was a Sunday). In a trial, can I use these errors to discredit the officer and perhaps raise a doubt to whether he actually saw my car make the prohibited ...

The time spent waiting for an early resolution meeting is considered a "neutral intake period" and doesn't count towards the overall length of delay.

Re: Speeding in Construction Zone, Fine Double but No Worker

Not sure I understand. The question I'm asking is whether the fine being doubled only applies when workers are actually *at* the site. There were no workers present at the site on the day/time of the ticket.

You haven't proved anything. You say there were no workers and the officer disagrees. You have been given the opportunity to request a ...

Re: Early resolution meeting SOS

Back from the courthouse. The Crown was nice. Did not ask what I plea. Looked through the file. I told him that I don't think that I did it. He looked at the accident report. Told me to go to trial. Told me to order the disclosure package.

He told you to go to trial because you told him you didn't do it. You basically said you weren't guilty. At ...

Re: Speeding in Construction Zone, Fine Double but No Worker

You're misunderstanding a bit here.

Just because you are in disagreement with the charge, doesn't mean the fine is incorrect. You were charged with speeding in a construction zone and the fine should reflect that.

Re: 60KM/H in a 40KM/H School Zone - School Zone Dropped.

Speeding carries its own set of demerit points. Speeding in designated zones will increase the fine, but wont change the points.

Your charge carries 3 demerit points. As it seems you are aware, any charge with 4 or more demerit points carries an automatic suspension for a novice driver. You are safe on that front.

I'm pretty sure any 4 or more ...

Re: 2 UP ATV/ORV Tickets

My apologies if you misunderstood but we are well aware of the requirements to licence and insure our off road vehicles. Yes we do have a plate (green) and yes we do have insurance through our auto insurance company. As I explained a 2 UP machine defined under the HTA Regulation 316-3 it is considered an ORV and not an ATV even though the only ...
