Re: Texting while driving in drive through
Short answer is no. Long answer is some roads within, lets say a large shopping area/mall, may have arrangements to be classified as a highway. Not that a drive thru line would have that type of classification, but if you're navigating through this type of area, be careful while you use the roads within.

Re: Pulled plates
If your car has been labelled unfit, you'll need to have it inspected and repaired so it is considered safe for the roads (safety certification). You'll need to replace your windshield, tires, and anything else deemed unfit in order to pass. You can't get your plates without passing, so start with the basics.

Re: Daughter charged with rolling stop
If there evidence showing there is no basis to the charge, they will drop it. They are not hiding evidence.jsherk wrote: If your daughter did stop, and the video shows it, then the prosecution will not want to use it as evidence and may not want to produce it. So you would be best to try and get a copy yourself.

Any evidence will be made available to you if requested. Any evidence will also be used in court if it's essential to the case.qube wrote:Anyway the officer advised her not to try to fight the infraction in court as he has the whole thing on dash cam! Do they present this type of evidence in court?

I'm also using the G1W. It's cheap, the reviews are almost always positive, and it's popular. There are plenty of threads and videos discussing this camera, so you don't have to worry too much about buying the unknown.

Re: 149 km/h on the 401
Once you get a Notice of Trial in the mail, request Disclosure (which will be officers notes) and a copy of the radar/lidar manual.
You're not going to get a copy of the manual. You'll get the 1 or 2 pages regarding testing at most. There's also the possibility that there was no device used since there's not enough detail in the post to know. In ...

Re: 149 km/h on the 401
I was recently busted doing 151 km/h on the 401 (officer bumped it to 149 to avoid impounding the rental). I realize I screwed up pretty hard, but I can't afford the insurance hike; so I really want to avoid this.

Unless there is more to this story, the other driver will be considered at fault. Regarding insurance claims, Ontario Fault Determination Rules put the other driver at 100% fault.

Re: No insurance, have courtdate, was insured under another
Thanks, in this case it mentions driving someone elses car, and in my case I drove my own second car, small difference, I don't see how that could make it any different, if anything that should be better for me, but likely not difference either way.
If you're wondering how your insurance provider would look at this situation (which isn't ...

Isn't there a police manual that says they have to estimate speed first, then measure to confirm?
The officer already confirms in his notes that he notices a vehicle traveling at a high rate of speed before using the device. There's no need for him to calculate a specific speed down to the km before using other measures, if that's what you're ...

Re: Radar detectors & tickets?
It's a ticket, you'll lose your device for good, and it will impact your insurance.
In most cases, having a radar warning device somewhere in your vehicle will fall under the "minor" offense category. It would be similar to a speeding conviction (except when listed as major or serious). There's also the good chance it will be tacked on to whatever ...

Out of Curiosity does anyone know what the lesser charge of 172(1) race a motor vehicle would be and any case law that would be relevant?
Generally, they are not in a hurry to offer you some reduced deal for this kind of charge. It doesn't mean it doesn't happen, but you'll have to prepare yourself for the possibility of being convicted.

Re: Diversion or amendment to by-law
The officer was correct. You have to surrender your insurance on demand. They are definitely under no obligation to wait while you contact your provider and have it emailed.
