Re: Disobey sign HTA section 182(2) - COURT JULY 22!!
Probably the only real defence strategy is to hope something is wrong with the sign from a legal perspective. Regulation 615 of the Highway Traffic Act lays out the requirements for signs, how they need to be posted, how far away they need to be visible from, etc.

Re: My responsibility?
It would be a complete guess as to why the officer issued you the ticket. At the end of the day some officers are more lenient and others are more strict in ensuring motorists comply with the law. Some will stop you for 10 over, others won't blink until you're going 30 over. If the officer stopped you for speeding she may have given you the ...

Re: My responsibility?
Police have some access to some insurance information from their car, but it's limited. Sometimes they can confirm a car is insured but sometimes it will say unknown. The only certain way for officers to check is to contact the actual insurance provider. You'd simply have to ask the officer on the stand. Again though even if she verified the ...

What do you think of me asking the officer on the stand if she charged the owner of the car for having the car on the road uninsured? When she says no I can ask, why not? Proving she knew it was insured or was negligent.

Re: RLC Ticket in Ottawa - Very Snowy Day!
Im not sure what speed youre using to calculate the stopping distance, but the Crown would simply argue you were going too fast. When weather conditions deteriorate, youre expected to slow to a speed that would have allowed you to safely stop, even if that means youre travelling well below the speed limit. If the conditions were unforeseen (i.e ...

Re: RLC Ticket in Ottawa - Very Snowy Day!
As its an absolute liability offence, the weather conditions aren't a defence. You're expected to drive slower in icy conditions so that you can stop if needed. You can see if the Crown will offer you any type of plea deal. You might be able to get your fine reduced by half. You can also make submissions upon being found guilty to the Justice of ...

If she pays $1000 or less it does not need to be reported
That's completely incorrect. It's not how much you decide to spend on repairs that determines if it's reportable, it's how much apparent damage there is. If the total damage (that means both vehicles combined) is $1,000 or more it MUST be reported by law. The damage to your vehicle alone ...

As we've stated above, random stops are allowed as per the Supreme Court. Police do NOT require grounds to believe an offence has occurred to stop a vehicle and check documentation.

Honestly actually my car was already damaged on similar parts. She did increase the damage but if your bumper is slightly smashed or extremely smashed you still have to replace a bumper. The damage she added was cracking the headlight covers. The cost of replacing that is less than $1000.

I feel I was targeted and the officer was just taking his chances in asking for my documents.
Does this fall under unlawful arbitrary seizure of documents? (There was no reasonable and probable grounds for the officer to ask for documentation)
Is it even considered a traffic stop under MVA since my care (edit: car) was already in park.

The damage did not appear that bad but its a bmw . Are you sure it would go as my fault with insurance?
When you strike a vehicle from behind you're considered 100% at fault. If the collision had occurred while she was still pulling out of the driveway fault would have been assigned to her.

Considering the OP has had 3 at fault collisions in as many months, even if this charge goes away like the rest, I think skyrocketing insurance rates is a given.Radar Identified wrote:While, as a licenced driver, you have a right to insurance, you'd then possibly be forced onto facility insurance... which is astronomically expensive.

Youre required by law to report any accident in which the apparent damage exceeds $1,000 to police. Youre also unfortunately 100% at fault for the accident based on insurance fault determination rules. Your insurance company would eventually be reimbursing her for the damage based on your description of the accident.

Yes, the suspension would still apply. Unfortunately the decision to suspend you isnt made by the Courts, its made by the MTO. Im not aware of any way to argue the suspension, basically its automatically applied once the MTO sees youve been convicted in Court.

Keep in mind theres a big difference between not listening to your wifes version of events and not agreeing with them. Police try their best to determine what happened based on the drivers and witness statements along with ...

I work on the enforcement side of things and even I find these seizures troubling. I do not believe a persons vehicle should be seized prior to any finding of guilt. If you are convicted at trial and the Court orders an impoundment, so be it. But until that happens, the property should remain with the defendant. The H.T.A. already provided police ...

That's ridiculous. I get that the tow truck company will want to be paid for the work, but it should be billed directly to the city since it was their error. Was it an actual city bylaw officer? Or someone acting under authority of the property owner? Some of the private parking enforcement agencies are somewhat sketchy.
