You'll have to go to Court. It's a pretty serious charge, so it may be worth seeking legal representation. You and your girlfriend will have to testify to the fact that she was driving and hopefully the Justice of the Peace will believe you.

That site is simply listing the steps you need to take to reinstate your licence if it's been suspended for more than one year. It doesn't mean you can get your licence back after one year if you're still suspended. That whole run is pretty amazing. He maintained an average speed of over 180km on 60km+ of roadway. I still cant beleive the recovery he made at the end of the video. I've watched it a couple of times and keep thinking the car is too far gone to recover.

He would be charged as the owner, which carries a fine but no demerit points. Its like red light cameras which simply identify the vehicle. He's still responsible even if he can show he wasn't the driver.

There is a sign posted prior to the intersection indicating it's a right turn lane. The sign is black square with a white border and a white arrow pointing right on it. That's a lawful sign under the HTA for lane use, indicating you must turn right. I don't believe heavy traffic is justification for proceeding straight through, but I'm not familiar ...

The Crown decides which (if any) ticket will be withdrawn in exchange for a plea. They're much more likely to withdraw the ownership charge, simply because it's seen as the less serious offence of the two. Just be aware that on many first requests typed notes are not granted. The request is time consuming and everyone asks for them before they've even seen the notes. If you can now honestly say the notes are illegible, file a second request explaining this. If the request isn't granted, you'll have to address this issue to the Courts.

There are no demerit points with that offence and there's probably a reasonable chance you'll be offered a reduced fine, especially in exchange for a guilty plea.

I don't think Toronto parking bylaws are actually online anywhere, because that would make things too simple. If I had to guess though, I imagine the actual wording would be 3 meters in either direction on the roadway in front of the hydrant's location, not 3 meters from the actual hydrant itself. The officer has up to 6 months from the date of the offence to charge you. If your fines were paid, then you should no longer be under suspension, but you may still be unlicensed unless you also paid a reinstatement fee. You can change your plea to guilty at your next trial date. The prosecutor won't raise the ticket back up to the full amount if there is no trial.

12 months seems to be the standard before an 11b motion is accepted by the Courts. I don't see 10 months cutting it, especially when your trial has already started.

Go with the lawyer's advice. I guarantee if you go to trial the charge will be amended to the full amount. Passing vehicles isn't justification for speeding, and it isn't like you were going just a little over. I think if you go to Court and try to argue you deserve a further reduction you'll get a nasty shock.

When they say failed to stop at a stop sign - its not as if I sped right through and wasnt aware there was a stop sign, I wasnt even going fast since I stopped behind the car in front of me. To the best of my knowledge, the the off ramp still considered part of the divided highway it exits from. If the 40 km/hr speed limit signs are yellow with black lettering, they're only a suggested speed, not an actual limit.

You can sometimes arrange to make partial monthly payments towards your fine, and you'll get your licence back as long as you keep paying.

A quick read of some sites relating to the Nova Scotia motor vehicle's act would indicate your licence can actually be suspended for 7 days for any speeding conviction of 15+ over the limit! :shock:

The two yellow signs are just advisory ones, meaning there is no real legal obligation to obey them. However between the two yellow signs in your link, there is the black square sign with a white arrow, which does legally mean the lane is right turn only.

If you received the ticket in Ontario, the total fine should be $353. With an Ontario licence, you'd receive 4 demerit points, which would result in a warning letter for new drivers but no suspension. You may be able to plea-bargain to "fail to report collision," which is nowhere near as serious as "fail to remain." However, make the disclosure request and see what evidence they have against you, if you have not already.
