As a police officer you should know everyone has only had 2 drinks.

Maybe some bars serve really big glasses of beer.

Re: Drive Motor Vehicle, No Currently Validated Permit ticke

Accourding to the traffic act "7(1)a nothing says your plates expire on your b-day

Not quite true. The section says you need a valid permit, which is defined under the Vehicle Permit section (O Reg 628). That section states that it expires on a specific day, month and year (i.e. a specific day of the month, not the end of the month). So Squishy ...

Can you advise where the accident actually took place? We can sometimes give better advice if we can see the actual road, signage, etc.

Re: Failure to stop for Bus by driver

Since you've been charged under section 175(19), it won't appear on your abstract at all. Assuming you pay the fine, the ticket will have no impact on your insurance rates, employment, etc. It would only appear on your abstract if you were charged as the driver.

If you really didn't commit the offence, you can certainly try to fight the charge in ...

Re: Seatbelt note

While I can't read the yellow font you've used, I'm not surprised the OPP don't believe you since you're using the Newfoundland Highway Traffic Act .

If you want to try something a little closer to home, go with the Ontario Highway Traffic Act. And yes, you're correct in that you're exempt. Ontario HTA exemptions, under section 106, are as ...

Re: failure to surrender insurance card

1) No, there would be no flag.
2) It means the licence plates aren't registered to a specific car, so in most cases they can't be used until registered to a different car.
3) It's starting to be possible. It's not perfect, but there is a centralized database that police can now access. Sometimes the provider still needs to be contacted to verify.

Re: How long does a conviction stay on your record?

No, conviction history is for life. The only way to get a conviction removed would be to have it overturned or shown it was added in error (i.e. someone impersonating you).

Re: Roadside Suspension

Other people have posted about insurance companies using administrative suspensions to increase their rates as well. If your friend argued the point and advised them of the FSCO bulletin, they should overlook the ADLS. That being said, with a criminal and HTA suspension, not sure how much difference getting the ADLS taken off will make.

Re: Roadside Suspension

I am not sure this is completely correct, as it does come up on the driver's abstract. Further to that it is regarded as an Alcohol related suspension, so its quite possible that it will.

You're correct in that all suspensions appear on your driving abstract, but that's more for police & MTO use. The Financial Services Commission of Ontario ...

Re: Obeying lane lights HTA 144(10)

2) Lane light would be a traffic light that is specific to a certain lane. I.e. a separate light for the left turn lane.
3) Correct. You can simply challenge the evidence the Crown presents and question their witness. You just wouldn't be able to present your version of events without testifying.
4) Possibly, though tickets don't have a location to ...

Re: How long does a conviction stay on your record?

I would say most agencies do have a local record system for keeping track of tickets issued, but it's not something that insurance companies look at. Since various agencies use different software, there's no easy way to access all of them. As well, most of the systems I'm familiar with only record tickets issued, not the outcome in Court, so it ...

Re: RED LIGHT TICKET- POOR WEATHER CONDITIONS?

Your argument will not cause them to drop the charges. First, you're expected to drive according to the road conditions. If there was heavy rain and your car had summer tires, the Courts would expect you to drive accordingly. In short, a speed that would have allowed you to safely stop for the red light. But more importantly, failing to stop for a ...

Re: Roadside Suspension

thanks for all the info I appreciate it, one more question though, does this 3 day suspension go on your insurance?
seems a little unfair that technically not being drunk or over .08 would get you into this kind of trouble

No. The roadside suspension is what's known as an administrative suspension, with no finding of guilt in Court. Because of ...

Yes. If you were caught lying in Court, you could face Criminal charges in addition to being found guilty of your current offence.
